SUBSTITUTE FOR
HOUSE BILL NO. 5530
A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1744.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1744. (1) Each intermediate school board shall appoint
2 a special education parent advisory committee. The parent
3 advisory committee and its officers shall consist only of parents
4 of pupils with disabilities, with at least 1 parent from each
5 constituent district and public school academy unless no parent
6 agrees to serve on the parent advisory committee to represent the
7 constituent district or public school academy. Each constituent
8 district board and each public school academy board of directors
9 shall nominate at least 1 parent to serve on the parent advisory
10 committee. The intermediate school board may appoint additional
11 members not to exceed 1/3 of the total parent advisory committee
1 membership.
2 (2) The intermediate school board shall make every attempt to
3 assure that all types of impairments and all identifiable
4 organizations of parents of pupils with disabilities within the
5 intermediate school district are represented on the parent
6 advisory committee.
7 (3) The intermediate school board may recommend operational
8 procedures for review and adoption by the parent advisory
9 committee.
10 (4) The intermediate school district shall secure or allocate
11 fiscal and staff resources to the parent advisory committee to
12 make it efficient and effective in operation.
13 (5) The parent advisory committee shall determine and
14 document, in writing, the organizational structure of the
15 committee, including at least all of the following:
16 (a) Officers and their responsibilities.
17 (b) Meeting times.
18 (c) Notice of meeting times.
19 (d) Voting procedures.
20 (e) Terms of office.
21 (f) Related matters.
22 (6) The parent advisory committee shall participate in the
23 development of the intermediate school district's plan or any
24 modification of the plan for the delivery of special education
25 programs and services as required by R 340.1833 of the Michigan
26 administrative code.
27 (7) The parent advisory committee may provide advisory input
1 on any matters that the committee considers appropriate to the
2 improvement of special education services within the intermediate
3 school district.
4 (8) The business that the parent advisory committee may
5 perform shall be conducted at a public meeting of the parent
6 advisory committee held in compliance with the open meetings act,
7 1976 PA 267, MCL 15.261 to 15.275.
8 (9) A writing prepared, owned, used, in the possession of, or
9 retained by the parent advisory committee in the performance of
10 an official function is subject to the freedom of information
11 act, 1976 PA 442, MCL 15.231 to 15.246.
