A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 14501 (MCL 324.14501), as amended by 1998 PA
289, and by adding section 14514.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 14501. As used in this part:
2 (a) "Department" means the department of environmental
3 quality.
4 (b) "Director" means the director of the department of
5 environmental quality.
6 (c) "Environmental wastes" means all environmental
7 pollutants, wastes, discharges, and emissions, regardless of how
8 they are regulated and regardless of whether they are released to
9 the general environment or the workplace environment.
10 (d) "Pollution prevention" means all of the following:
1 (i) "Source reduction" as defined in the pollution prevention
2 act of 1990, subtitle G of title VI of the omnibus budget
3 reconciliation act of 1990, Public Law 101-508, 42 U.S.C. 13101
4 to 13109.
5 (ii) "Pollution prevention" as described in the United States
6 environmental protection agency's pollution prevention statement
7 dated June 15, 1993.
8 (iii) Environmentally sound on-site or off-site reuse or
9 recycling.
10 (e) "RETAP" means the retired engineers technical assistance
11 program created in section 14511.
12 (f) "Retap fund" means the retired engineers technical
13 assistance program fund created in section 14512.
14 (g) "Small business" means a business that is not dominant in
15 its field as defined in 13 C.F.R. part 121, and meets both of the
16 following requirements:
17 (i) Is independently owned or operated, by a person that
18 employs 500 or fewer individuals.
19 (ii) Is a small business concern as defined in the small
20 business act, Public Law 85-536, 72 Stat. 384.
21 Sec. 14514. The department may promulgate rules to
22 implement and administer this part.
23 Enacting section 1. This amendatory act does not take
24 effect unless Senate Bill No. 723
25 of the 92nd Legislature is enacted into
26 law.
