                           SENATE BILL NO. 854                                  

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                 A bill to amend 1994 PA 451, entitled                                             

                                                                                

    "Natural resources and environmental protection act,"                       

                                                                                

    (MCL 324.101 to 324.90106) by adding part 174.                              

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1               PART 174.  STATEWIDE RECYCLING COORDINATOR                      

                                                                                

2       Sec. 17401.  As used in this part:                                          

                                                                                

3       (a) "Department" means the department of environmental                      

                                                                                

4   quality.                                                                    

                                                                                

5       (b) "Director" means the director of the department.                        

                                                                                

6       (c) "Recycling advisory council" means the recycling advisory               

                                                                                

7   council created in section 17302.                                           

                                                                                

8       Sec. 17402.  (1) The office of the statewide recycling                      

                                                                                

9   coordinator is created in the department.                                   

                                                                                

10      (2) The statewide recycling coordinator shall be appointed by               

                                                                                

11  the director and serve at the director's pleasure.  The statewide           

                                                                                


                                                                                

1   recycling coordinator shall receive compensation as determined by           

                                                                                

2   the director and shall be reimbursed for all traveling and other            

                                                                                

3   expenses incurred by him or her in the discharge of his or her              

                                                                                

4   official duties.  The department, as recommended by the statewide           

                                                                                

5   recycling coordinator, may employ assistants and make                       

                                                                                

6   expenditures necessary to implement this part and perform the               

                                                                                

7   powers and duties of the statewide recycling coordinator.                   

                                                                                

8       Sec. 17403.  The statewide recycling coordinator shall do                   

                                                                                

9   all of the following:                                                       

                                                                                

10      (a) In conjunction with the recycling advisory council,                     

                                                                                

11  establish a method for regular review of local recycling programs           

                                                                                

12  in this state.                                                              

                                                                                

13      (b) Gather information about recycling processes, markets,                  

                                                                                

14  and rates.                                                                  

                                                                                

15      (c) As required by the legislature, conduct and submit a                    

                                                                                

16  study of the capacity of this state to handle material recovered            

                                                                                

17  for recycling, the feasibility of collecting and transporting               

                                                                                

18  material for recycling in this state, and the ability of this               

                                                                                

19  state to sustain markets for products containing recycled                   

                                                                                

20  content.                                                                    

                                                                                

21      (d) As required by the legislature, submit recommendations                  

                                                                                

22  for improving and expanding recycling in this state.                        

                                                                                

23      (e) Perform any other duties imposed by law or the director.                

                                                                                

24      Enacting section 1.  This amendatory act does not take                      

                                                                                

25  effect unless Senate Bill No. 790 of the 92nd Legislature is                

                                                                                

26  enacted into law.
