HOUSE SUBSTITUTE FOR
SENATE BILL NO. 1068
A bill to make appropriations for the department of natural
resources for the fiscal year ending September 30, 2005; to provide
for the expenditure of those appropriations; to create funds and
accounts; to require reports; to prescribe certain powers and duties
of certain state agencies and officials; to authorize certain
transfers by certain state agencies; and to provide for the
disposition of fees and other income received by the various state
agencies.

3 PROVISIONS CONCERNING APPROPRIATIONS
4 GENERAL SECTIONS
5 Sec. 201. Pursuant to section 30 of article IX of the state
6 constitution of 1963, total state spending from state resources under
7 part 1 for the fiscal year ending September 30, 2005 is
8 [$212,982,000.00] and state spending from state resources to be paid to
9 local units of government for the fiscal year ending September 30,
10 2005 is $13,714,200.00. The itemized statement below identifies
11 appropriations from which spending to units of local government will
12 occur:

22 Sec. 202. The appropriations authorized under this act are
23 subject to the management and budget act, 1984 PA 431, MCL 18.1101 to
24 18.1594.
25 Sec. 203. As used in this act:
1 (a) "Commission" means the commission of natural resources.
2 (b) "DAG" means the United States department of agriculture.
3 (c) "Department" means the department of natural resources.
4 (d) "DHS" means the United States department of homeland security.
5 (e) "DOC" means the United States department of commerce.
6 (f) "DOD" means the United States department of defense.
7 (g) "DOE" means the United States department of energy.
8 (h) "DOI" means the United States department of interior.
9 (i) "DOT" means the United States department of transportation.
10 (j) "EPA" means the United States environmental protection agency.
11 (k) "FTE" means full-time equated.
12 (l) "IDG" means interdepartmental grant.
13 (m) "USCG" means the United States coast guard.
14 Sec. 204. The department of civil service shall bill departments
15 and agencies at the end of the first fiscal quarter for the 1% charge
16 authorized by section 5 of article XI of the state constitution of
17 1963. Payments shall be made for the total amount of the billing by
18 the end of the second fiscal quarter.
19 Sec. 205. (1) A hiring freeze is imposed on the state classified
20 civil service. State departments and agencies are prohibited from
21 hiring any new full-time state classified civil service employees and
22 prohibited from filling any vacant state classified civil service
23 positions. This hiring freeze does not apply to internal transfers of
24 classified employees from 1 position to another within a department.
25 (2) The state budget director shall grant exceptions to this
26 hiring freeze when the state budget director believes that the hiring
27 freeze will result in rendering a state department or agency unable to
1 deliver basic services, cause loss of revenue to the state, result in
2 the inability of the state to receive federal funds, or necessitate
3 additional expenditures that exceed any savings from maintaining a
4 vacancy. The state budget director shall report quarterly to the
5 chairpersons of the senate and house of representatives standing
6 committees on appropriations the number of exceptions to the hiring
7 freeze approved during the previous quarter and the reasons to justify
8 the exceptions.
9 Sec. 206. (1) In addition to the funds appropriated in part 1,
10 there is appropriated an amount not to exceed $3,000,000.00 for
11 federal contingency funds. These funds are not available for
12 expenditure until they have been transferred to another line item in
13 this act under section 393(2) of the management and budget act, 1984
14 PA 431, MCL 18.1393.
15 (2) In addition to the funds appropriated in part 1, there is
16 appropriated an amount not to exceed $5,000,000.00 for state
17 restricted contingency funds. These funds are not available for
18 expenditure until they have been transferred to another line item in
19 this act under section 393(2) of the management and budget act, 1984
20 PA 431, MCL 18.1393.
21 (3) In addition to the funds appropriated in part 1, there is
22 appropriated an amount not to exceed $100,000.00 for local contingency
23 funds. These funds are not available for expenditure until they have
24 been transferred to another line item in this act under section 393(2)
25 of the management and budget act, 1984 PA 431, MCL 18.1393.
26 (4) In addition to the funds appropriated in part 1, there is
27 appropriated an amount not to exceed $500,000.00 for private
1 contingency funds. These funds are not available for expenditure
2 until they have been transferred to another line item in this act
3 under section 393(2) of the management and budget act, 1984 PA 431,
4 MCL 18.1393.
5 Sec. 207. At least 60 days before beginning any effort to
6 privatize, the department shall submit a complete project plan to the
7 appropriate senate and house of representatives appropriations
8 subcommittees and the senate and house fiscal agencies. The plan
9 shall include the criteria under which the privatization initiative
10 will be evaluated. The evaluation shall be completed and submitted to
11 the appropriate senate and house of representatives appropriations
12 subcommittees and the senate and house fiscal agencies within 30
13 months.
14 Sec. 208. The department shall use the Internet to fulfill the
15 reporting requirements of this act. This may include transmission of
16 reports via electronic mail to the recipients identified for each
17 reporting requirement or it may include placement of reports on an
18 Internet or Intranet site.
19 Sec. 209. By February 15, 2005, the department shall provide the
20 state budget director, the senate and house appropriations
21 subcommittees on natural resources, and the senate and house fiscal
22 agencies with an annual report on estimated restricted fund balances,
23 projected revenues, and expenditures for the fiscal years ending
24 September 30, 2004 and September 30, 2005.
25 Sec. 210. (1) From the funds appropriated under part 1, the
26 department shall prepare a report that lists all of the following
27 regarding grant, loan, or grant and loan programs administered by the
1 department for the fiscal year ending on September 30, 2005:
2 (a) The name of each program.
3 (b) The goals, criteria, filing fees, nominating procedures,
4 eligibility requirements, processes, and deadlines for each program.
5 (c) The maximum and minimum grant and loan available and whether
6 there is a match requirement for each program.
7 (d) The amount of any required match, and whether in-kind
8 contributions may be used as part or all of a required match.
9 (e) Information pertaining to the application process, timeline
10 for each program, and the contact people within the department.
11 (f) The source of funds for each program, including the citation
12 of pertinent authorizing acts.
13 (g) Information regarding plans for the next fiscal year for the
14 phaseout, expansion, or changes for each program.
15 (h) A listing of all recipients of grants or loans awarded by the
16 department by type and amount of grant or loan during the fiscal year
17 ending September 30, 2004.
18 (2) The reports required under this section shall be submitted to
19 the state budget director, the senate and house appropriations
20 committees and the senate and house fiscal agencies by January 1,
21 2005.
22 Sec. 211. Appropriations of state restricted game and fish
23 protection funds have been made to the following departments and
24 agencies in their respective appropriation acts. The amounts
25 appropriated to these departments and agencies are limited to the
26 amounts listed below:

5 Sec. 212. The department shall develop a plan for allocating
6 restricted funds among department administrative support and
7 regulatory activities. This plan shall be submitted to the house and
8 senate appropriations subcommittees on natural resources by January
9 30, 2005. This plan shall include a cost allocation plan for
10 financial services support, office space rent and building occupancy
11 charges, support division service for information systems and
12 technology, and a methodology to use information generated through
13 activity reports that identifies the percentage of employee time spent
14 on restricted fund activities.
15 Sec. 213. Pursuant to section 43703(3) of the natural resources
16 and environmental protection act, 1994 PA 451, MCL 324.43703, there is
17 appropriated from the game and fish protection trust fund to the game
18 and fish protection fund, $6,000,000.00 for the fiscal year ending
19 September 30, 2005.
20 Sec. 214. From the funds appropriated in part 1 for information
21 technology, the department shall pay user fees to the department of
22 information technology for technology-related services and projects.
23 Such user fees shall be subject to provisions of an interagency
24 agreement between the department and the department of information
25 technology.
26 Sec. 215. Amounts appropriated in part 1 for information
27 technology may be designated as work projects and carried forward to
1 support technology projects under the direction of the department of
2 information technology. Funds designated in this manner are not
3 available for expenditure until approved as work projects under
4 section 451a of the management and budget act, 1984 PA 431,
5 MCL 18.1451a.
6 Sec. 216. Funds appropriated in part 1 shall not be used for the
7 purchase of foreign goods or services, or both, if competitively
8 priced and comparable quality American goods or services, or both, are
9 available. Preference should be given to goods or services, or both,
10 manufactured or provided by Michigan businesses if they are
11 competitively priced and of comparable quality.
12 Sec. 217. On or before April 1, 2005, the department shall
13 certify to the state treasurer the amounts to be paid to local
14 governmental units in lieu of local property taxes on purchased lands,
15 as provided for in subpart 14 of part 21 of the natural resources and
16 environmental protection act, 1994 PA 451, MCL 324.2152 to 324.2154.
17 Payments in lieu of taxes for purchased lands shall be charged against
18 the appropriation for this purpose in section 110 of this act.
19 Sec. 218. The payment in lieu of tax payment for the ski hill
20 concession in the Porcupine Mountains state park shall be made from
21 revenue realized through ski hill operations.
22 Sec. 219. Any savings realized through the implementation of
23 negotiated state employee contracts shall lapse and be credited to the
24 funding source from which appropriations are made.
25 Sec. 220. The negative appropriation in section 113 for
26 budgetary savings in part 1 shall be satisfied through a
27 departmentwide general fund reduction plan developed by the
1 department. Appropriation authorization adjustments required to
2 implement the negative appropriation shall be made after legislative
3 approval of transfers pursuant to section 393(2) of the management and
4 budget act, 1984 PA 431, MCL 18.1393.
5 ADMINISTRATIVE SERVICES
6 Sec. 401. The department may charge the appropriations contained
7 in part 1, including all special maintenance and capital projects
8 appropriated for the fiscal year ending September 30, 2005, for
9 engineering services provided, a standard percentage fee to recover
10 actual costs. The department may use the revenue derived to support
11 the engineering services charges provided for in part 1.
12 Sec. 402. The department may charge land acquisition projects
13 appropriated for the fiscal year ending September 30, 2005, and for
14 prior fiscal years, a standard percentage fee to recover actual costs,
15 and may use the revenue derived to support the land acquisition
16 service charges provided for in part 1.
17 Sec. 403. The department of natural resources may charge both
18 application fees and transaction fees related to the exchange or sale
19 of state-owned land or rights in land and authorized by part 21 of the
20 natural resources and environmental protection act, 1994 PA 451, MCL
21 324.2101 to 324.2162. The fees shall be set by the director at a rate
22 which allows the department to recover its costs for providing these
23 services.
24 Sec. 404. The department shall report quarterly on all land
25 transactions completed by the department in the previous fiscal
26 quarter. For each land transaction, the report shall include, but not
1 be limited to, the size of the parcel, the county and municipality in
2 which the parcel is located, the dollar amount of the transaction, the
3 fund source used to purchase the parcel, and the type of transaction,
4 such as tax reversion, purchase, public auction, transfer, exchange,
5 or conveyance. The report shall be submitted to the senate and house
6 appropriations subcommittees on natural resources within 21 days after
7 the end of each fiscal quarter.
8 WILDLIFE MANAGEMENT
9 Sec. 501. By April 1, 2005 and September 30, 2005, the
10 department shall report to the state budget director, the senate and
11 house appropriations subcommittees on natural resources, and the
12 senate and house fiscal agencies on spending from the amounts
13 appropriated in part 1 for bovine tuberculosis control efforts. The
14 report shall include, but not be limited to, information on activities
15 at the animal diagnostic laboratory at Michigan State University that
16 are funded with appropriations in part 1.
17 Sec. 502. Of the funds appropriated in part 1, the department
18 shall reimburse the department of agriculture for costs incurred for
19 indemnification payments for livestock losses caused by wolves or
20 coyotes under the animal industry act, 1988 PA 466, MCL 287.701 to
21 287.745.
22 Sec. 503. The department may enter into land rental agreements
23 for the cultivation of agricultural products, provided contractual
24 lease rates reflect the prevailing or average rental rate per acre for
25 comparable soil types or crop use in the county or adjoining leased
26 properties. Lease revenue shall be deposited into the game and fish
1 protection fund.
2 FISHERIES MANAGEMENT
3 Sec. 601. As a condition of expenditure of fisheries management
4 appropriations under part 1, the department shall not impede the
5 certification process for water control structures on Michigan
6 waterways. The department shall fund from funds appropriated in
7 part 1 all non-water-quality studies or requirements that the
8 department requests of either of the following:
9 (a) The department of environmental quality as a condition for
10 issuance of a certification under the federal water pollution control
11 act, 33 USC 1341.
12 (b) The federal energy regulatory commission as a condition of
13 licensing under the federal power act, 16 USC 791a to 825r.
14 Sec. 602. (1) From the appropriation in part 1 for aquatic
15 resource mitigation, not more than $758,000.00 shall be allocated for
16 grants to watershed councils, resource development councils, soil
17 conservation districts, local governmental units, and other nonprofit
18 organizations for stream habitat stabilization and soil erosion
19 control.
20 (2) The fisheries division of the department shall develop
21 priority and cost estimates for all recommended projects.
22 PARKS AND RECREATION
23 Sec. 701. Pursuant to section 1902(2) of the natural resources
24 and environmental protection act, 1994 PA 451, MCL 324.1902, there is
25 appropriated from the Michigan natural resources trust fund to the
Senate Bill No. 1068 (H-1) as amended June 9, 2004
1 Michigan state parks endowment fund an amount not to exceed
2 $10,000,000.00 for the fiscal year ending September 30, 2005.
3 Sec. 702. (1) The department shall prepare detailed reports for
4 construction projects in state parks that will involve campsite or
5 campground closures. These reports shall include expected costs,
6 impacts on recreation opportunities, impacts on state park revenues,
7 and the expected impact on state park users. The department shall
8 also prepare reports on average monthly campground occupancy rates for
9 every state park during the previous summer season. The department
10 shall provide reports described in this subsection to the house and
11 senate appropriations subcommittees on natural resources and the house
12 and senate fiscal agencies not later than April 1, 2005.
13 (2) The department shall notify the house and senate
14 appropriations subcommittees on natural resources and the house and
15 senate fiscal agencies if it intends to reduce operations or reduce
16 recreation opportunities at any state park or recreation area.
[Sec. 703. The department shall place an appropriate number of
defibrillators in state parks. The department may accept donated defibrillators.]
17 FOREST, MINERAL, AND FIRE MANAGEMENT
18 Sec. 801. The department shall follow the certification criteria
19 established by the forest stewardship council and the sustainable
20 forest initiative in its timber marking activities. The department
21 shall report by September 30, 2005 to the state budget director, the
22 senate and house appropriations subcommittees on natural resources,
23 the senate and house standing committees on natural resources issues,
24 and the senate and house fiscal agencies on the status of its forest
25 management plan.
26 Sec. 802. The appropriation for the adopt-a-forest program in
27 part 1 shall be used to cover the cost of disposing of waste material
1 collected from state forest lands.
2 Sec. 803. In addition to the funds appropriated in part 1,
3 $350,000.00 is appropriated to cover costs related to any declared
4 emergency involving the collapse of any abandoned mine shaft located
5 on state land. This appropriation shall not be expended unless the
6 state budget director recommends the expenditure and the department
7 notifies the house and senate committees on appropriations.
8 Sec. 804. As a condition of expenditure of appropriations in
9 part 1 from forest development funds, on October 15, 2004 the
10 department shall provide $1,000,000.00 from cooperative resources
11 programs as an interdepartmental grant to the department of
12 agriculture for the cooperative resources management initiative
13 program for the purposes of supporting forestry programs in local
14 conservation districts.
15 Sec. 805. The department shall designate 1 forester to implement
16 management initiatives to facilitate the development of forest
17 products from department-managed properties in southwest Michigan.
18 The department shall develop a forest management plan for these
19 lands. This plan shall be submitted to the house and senate
20 appropriations subcommittees on natural resources on or before April
21 1, 2005.
22 Sec. 806. Of the funds appropriated in part 1, the department
23 shall prescribe appropriate treatment on 63,000 acres, plus or minus
24 10%, at the current average rate of 12.5 to 13 cords per acre,
25 provided that the department shall take into consideration the impact
26 of timber harvesting on wildlife habitat and recreation uses. The
27 department shall endeavor to increase marking or treatment of hardwood
1 timber by 10% over 2004 levels. In addition, the department shall
2 take into consideration silvicultural analysis and report annually to
3 the legislature on plans and efforts to address factors limiting
4 management of timber.
5 Sec. 807. Forest camping fees shall not be assessed for
6 dispersed camping in state forests.
7 LAW ENFORCEMENT
8 Sec. 901. The appropriation in part 1 for snowmobile law
9 enforcement grants shall be used to provide grants to county law
10 enforcement agencies to enforce part 821 of the natural resources and
11 environmental protection act, 1994 PA 451, MCL 324.82101 to 324.82160,
12 including rules promulgated under that part and ordinances enacted
13 pursuant to that part. The department shall consider the number of
14 enforcement hours and the number of miles of snowmobile trails in each
15 county in allocating these grants. Any funds not distributed to
16 counties revert back to the snowmobile registration fee fund.
17 Counties shall provide semiannual reports to the department.
18 GRANTS
19 Sec. 1101. The amount appropriated in part 1 for federal-rural
20 community fire protection shall be awarded as grants to local fire
21 protection departments. To be eligible, local fire protection
22 departments shall be located in governmental units or fire protection
23 districts with permanent populations of less than 10,000.
24 Sec. 1102. Federal pass-through funds to local institutions and
25 governments that are received in amounts in addition to those included
1 in part 1 for grants to communities - federal oil, gas, and timber
2 payments and that do not require additional state matching funds are
3 appropriated for the purposes intended. By November 30, 2004, the
4 department shall report to the senate and house appropriations
5 subcommittees on natural resources, the senate and house fiscal
6 agencies, and the state budget director on all amounts appropriated
7 under this section during the fiscal year ending September 30, 2004.
8 Sec. 1103. (1) The use of federal funding received by the state
9 from the land and water conservation fund and appropriated in part 1
10 shall be coordinated with state grants to local units of government
11 from the Michigan natural resources trust fund. The coordination of
12 the 2 funding sources shall be conducted in a manner that minimizes
13 the total matching funds required from local units of government for
14 local land acquisition or recreational development projects.
15 (2) The Michigan natural resources trust fund board shall report
16 on the final disposition of federal funding from the land and water
17 conservation fund in the board's annual report to the legislature.
