    SUBSTITUTE FOR

    SENATE BILL NO. 1472

                                                                             A bill to amend 1974 PA 258, entitled                                             

"Mental health code,"                                                       

by amending section 415 (MCL 330.1415), as amended by 1995 PA               

290.                                                                        

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1       Sec. 415.  Subject to section 410, an individual 18 years of                

2   age or over may be hospitalized as a formal voluntary patient if            

3   the individual executes an application for hospitalization as a             

4   formal voluntary patient or the individual assents and the full             

5   guardian of the individual,  or  the limited guardian with                  

6   authority to admit, or a patient advocate authorized by the                 

7   individual to make mental health treatment decisions under the              

8   estates and protected individuals code, 1998 PA 386, MCL 700.1101           

9   to 700.8102, executes an application for hospitalization and if             

10  the hospital director considers the individual to be clinically             

1   suitable for that form of hospitalization.                                  

2       Enacting section 1.  This amendatory act does not take                      

3   effect unless all of the following bills of the 92nd Legislature            

4   are enacted into law:                                                       

5       (a) Senate Bill No. 1464.                                                   

6       (b) Senate Bill No. 1468.                                                   

7       (c) Senate Bill No. 1469.                                                   

8       (d) Senate Bill No. 1470.                                                   

9       (e) Senate Bill No. 1471.
