A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
by amending section 2543 (MCL 600.2543), as amended by 1986 PA
308.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2543. (1) The circuit court reporters or recorders
2 shall be are entitled to demand and receive per page
for a
3 transcript ordered by any person the sum of $1.75 per original
4 page and 30 cents per page for each copy, unless a lower rate is
5 agreed upon. For a transcript ordered by the circuit judge,
6 reporters or recorders shall
be are entitled to receive from
7 the county the same compensation. The supreme court, by
8 administrative order or court rule, may authorize the payment to
9 circuit court reporters or recorders the sum of $3.00 per
10 original page and 50 cents for each copy for transcripts ordered
1 and timely filed as part of a program of differentiated case
2 management for appeals of civil cases in which circuit courts
3 either grant or deny summary disposition. If a transcript
4 ordered under a program of differentiated case management is not
5 timely filed, the circuit court reporter or recorder is not
6 entitled to receive the increased rate for that transcript.
7 (2) Only if the transcript is desired for the purpose of
8 moving for a new trial or preparing a record for appeal shall the
9 amount of reporters' or recorders' fees paid for the transcript
10 be recovered as a part of the taxable costs of the prevailing
11 party in the motion, in the court of appeals or the supreme
12 court.
