                                                                                 A bill to amend 1994 PA 451, entitled                                             

                                                                                

    "Natural resources and environmental protection act,"                       

                                                                                

    by amending section 74101 (MCL 324.74101), as added by 1995 PA              

                                                                                

    58, and by adding section 74102a.                                           

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 74101.  As used in this part:                                          

                                                                                

2       (a) "Committee" means the citizens committee for Michigan                   

                                                                                

3   state parks created in section 74102a.                                      

                                                                                

4       (b)  (a)  "Fund" means the state park improvement fund                      

                                                                                

5   created in section 74108.                                                   

                                                                                

6       (c)  (b)  "Improvement program" means the construction,                     

                                                                                

7   reconstruction, development, improvement, bettering, operating,             

                                                                                

8   maintaining, and extending a facility at a state park, including            

                                                                                

9   a site improvement, impoundment, road and parking lot, toilet               

                                                                                

10  building, concession building, shelter building, bathhouse,                 

                                                                                


                                                                                

1   utility, outdoor center, visitor service facility, ski area, ski            

                                                                                

2   tow, ski shelter, and administration unit.                                  

                                                                                

3       (d)  (c)  "Motor vehicle" means a vehicle that is                           

                                                                                

4   self-propelled.                                                             

                                                                                

5       (e)  (d)  "State park" means a state park or state recreation               

                                                                                

6   area designated by the director.                                            

                                                                                

7       (f)  (e)  "State park revenues" means all revenues collected                

                                                                                

8   for state parks, including but not limited to, motor vehicle                

                                                                                

9   permits, concession fees, nonmotorized trail permits, fees,                 

                                                                                

10  leases, camping fees, sale of farm animals from Maybury state               

                                                                                

11  park, donations, and gifts.                                                 

                                                                                

12      Sec. 74102a.  (1) The citizens committee for Michigan state                 

                                                                                

13  parks is created within the department.                                     

                                                                                

14      (2) The committee shall consist of 17 individuals appointed                 

                                                                                

15  by the director with the advice of the commission.                          

                                                                                

16      (3) The members first appointed to the committee shall be                   

                                                                                

17  appointed within 60 days after the effective date of the                    

                                                                                

18  amendatory act that added this section.                                     

                                                                                

19      (4) Members of the committee shall serve for terms of 4 years               

                                                                                

20  or until a successor is appointed, whichever is later, except               

                                                                                

21  that of the members first appointed 6 shall serve for 4 years, 6            

                                                                                

22  shall serve for 3 years, and 5 shall serve for 2 years.                     

                                                                                

23      (5) If a vacancy occurs on the committee, the director shall                

                                                                                

24  make an appointment for the unexpired term in the same manner as            

                                                                                

25  the original appointment.                                                   

                                                                                

26      (6) The committee may remove a member of the committee for                  

                                                                                

27  incompetency, dereliction of duty, malfeasance, misfeasance, or             


                                                                                

1   nonfeasance in office, or any other good cause upon a majority              

                                                                                

2   vote of the members.  An individual shall be removed from the               

                                                                                

3   committee if he or she does not attend 4 consecutive meetings of            

                                                                                

4   the committee.                                                              

                                                                                

5       (7) The first meeting of the committee shall be called by the               

                                                                                

6   director.  At the first meeting, the committee shall elect from             

                                                                                

7   among its members a chairperson and other officers as it                    

                                                                                

8   considers necessary or appropriate.  After the first meeting, the           

                                                                                

9   committee shall meet at least twice each year, or more frequently           

                                                                                

10  at the call of the chairperson or if requested by 9 or more                 

                                                                                

11  members.                                                                    

                                                                                

12      (8) Six members of the committee constitute a quorum for the                

                                                                                

13  transaction of business at a meeting of the committee.  A                   

                                                                                

14  majority of the members present and serving are required for                

                                                                                

15  official action of the committee.                                           

                                                                                

16      (9) The business that the committee may perform shall be                    

                                                                                

17  conducted at a public meeting of the committee held in compliance           

                                                                                

18  with the open meetings act, 1976 PA 267, MCL 15.261 to 15.275.              

                                                                                

19      (10) A writing prepared, owned, used, in the possession of,                 

                                                                                

20  or retained by the committee in the performance of an official              

                                                                                

21  function is subject to the freedom of information act, 1976 PA              

                                                                                

22  442, MCL 15.231 to 15.246.                                                  

                                                                                

23      (11) Members of the committee shall serve without                           

                                                                                

24  compensation.  However, members of the committee may be                     

                                                                                

25  reimbursed for their actual and necessary expenses incurred in              

                                                                                

26  the performance of their official duties as members of the                  

                                                                                

27  committee.                                                                  


                                                                                

1       (12) The committee shall do all of the following:                           

                                                                                

2       (a) Advise and make recommendations to the governor, the                    

                                                                                

3   commission, and the legislature on state parks policy and provide           

                                                                                

4   guidance on state parks development, management, and planning               

                                                                                

5   issues.                                                                     

                                                                                

6       (b) Seek the development of a broad variety of programs,                    

                                                                                

7   facilities, and services for our citizens utilizing the state               

                                                                                

8   parks.                                                                      

                                                                                

9       (c) Inform and educate the public about the importance of and               

                                                                                

10  need for state parks.                                                       

                                                                                

11      (d) Strive to involve citizens in the planning and                          

                                                                                

12  development of state parks and to ensure that the facilities,               

                                                                                

13  programs, and projects are barrier-free and accessible to all               

                                                                                

14  citizens.                                                                   

                                                                                

15      (e) Establish and maintain effective public relations                       

                                                                                

16  regarding state parks, utilizing all appropriate communications             

                                                                                

17  media.                                                                      

                                                                                

18      (f) Advise on financial planning and pursue adequate budget                 

                                                                                

19  support for state parks.                                                    

                                                                                

20      (g) Serve as a liaison and coordinate with other agencies to                

                                                                                

21  ensure a cooperative effort to provide the most effective and               

                                                                                

22  economical services possible at state parks.                                

                                                                                

23      (h) Evaluate the state parks programs, facilities, services,                

                                                                                

24  and relationships periodically to assure that the committee's               

                                                                                

25  goals and objectives are being achieved.                                    

                                                                                

26      (i) Advise and make recommendations to the department on the                

                                                                                

27  gem of the parks award, the state parks volunteer of the year               


                                                                                

1   award, and the state parks employee of the year award established           

                                                                                

2   under section 74124.                                                        

                                                                                

3       (13) The chairperson of the committee shall ensure that all                 

                                                                                

4   proposed policy positions of the committee are sent to the                  

                                                                                

5   committee members at least 1 week in advance of the meeting at              

                                                                                

6   which the policy position will be acted upon.  The committee may            

                                                                                

7   adopt an emergency resolution that has not been sent to committee           

                                                                                

8   members at least 1 week prior to a meeting of the committee, but            

                                                                                

9   only upon the approval of 3/4 of those present at the meeting.
