A bill to amend 1976 PA 451, entitled
"The revised school code,"
by amending section 1233b (MCL 380.1233b), as amended by 1995 PA
289.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1233b. (1) Except as provided in subsection (3), the
2 board of a local or intermediate school district or governing
3 board of a nonpublic school may engage a full-time or part-time
4 noncertificated,
nonendorsed teacher to teach a course in
5 computer science, a
foreign language, mathematics, biology,
6 chemistry,
engineering, physics, robotics, or in another subject
7 area determined by the
state board to be appropriate to be
8 included under this
section and so designated by the state board,
9 or any combination of
these subject areas, in grades 9
through
10 12 if he or she meets the requirements of subsection (2).
1 (2) Subject to subsection (3), a noncertificated, nonendorsed
2 teacher is qualified to teach pursuant to this section if he or
3 she meets all 1
or both of the following minimum requirements:
4 (a) Possesses an earned master's or doctorate degree from an
5 accredited postsecondary institution in a field of study related
6 to the subject that he or she is assigned to teach.
7 (b) (a) Possesses
an earned bachelor's degree from an
8 accredited postsecondary
institution . and meets both of the
9 following:
10 (i) (b) Has
a major or a graduate degree in the field of
11 specialization study in which he or she will teach.
12 (ii) Is annually and continually enrolled and completing
13 credit in an approved teacher preparation program leading to a
14 teaching certificate.
15 (c) If the
teacher desires to teach for more than 1 year,
16 has passed both a
basic skills examination and a subject area
17 examination, if a
subject area examination exists, in the field
18 of specialization in
which he or she will teach.
19 (d) Except in the
case of persons engaged to teach a foreign
20 language, has, in the
5-year period immediately preceding the
21 date of hire, not less
than 2 years of occupational experience in
22 the field of
specialization in which he or she will teach.
23 (3) The requirements listed in subsection (2) for a teacher
24 engaged to teach pursuant to this section shall be in addition to
25 any other requirements established by the board of a local or
26 intermediate school district or governing board of a nonpublic
27 school, as applicable.
1 (4) Except as
provided in subsection (5), the board of a
2 local or intermediate
school district shall not engage a
3 full-time or part-time
noncertificated, nonendorsed teacher to
4 teach a course
described in subsection (1) if the district is
5 able to engage a
certificated, endorsed teacher.
6 (5) If the board
of a local or intermediate school district
7 is able to engage a
certificated, endorsed teacher to teach a
8 course described in
subsection (1), the local or intermediate
9 school board may
employ or continue to employ a noncertificated,
10 nonendorsed teacher to
teach the course if both of the following
11 conditions are met:
12 (a) The
noncertificated, nonendorsed teacher is annually and
13 continually enrolled
and completing credit in an approved teacher
14 preparation program
leading to a provisional teaching
15 certificate.
16 (b) The
noncertificated, nonendorsed teacher has a planned
17 program leading to
teacher certification on file with the
18 employing school
district or intermediate school district, his or
19 her teacher
preparation institution, and the department of
20 education.
21 (4) (6) If
the noncertificated, nonendorsed teacher
22 completes 3 years of successful classroom teaching, as determined
23 by regular observation and review by school district and teacher
24 preparation institution
personnel, the department of education
25 and a teacher preparation institution shall utilize the teaching
26 experience of a noncertificated, nonendorsed teacher for the
27 purpose of waiving student teaching as a condition for receiving
1 a continued
employment authorization in the school district and
2 a provisional teaching certificate.
