A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1061.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1061. (1) The board of a school district may cancel a
2 regular or special election before the date of the election if
3 all of the following apply:
4 (a) There is no question on the ballot at the election other
5 than the election of school board members.
6 (b) The deadline has passed for filing a declaration of
7 intent to be a write-in candidate under section 737a of the
8 Michigan election law, 1954 PA 116, MCL 168.737a.
9 (c) There is not more than 1 candidate on the ballot for each
10 office on the ballot.
11 (2) If an election is canceled under subsection (1), the
1 candidate on the ballot for each office on the ballot shall be
2 considered elected to that office for all purposes under this act
3 and the Michigan election law, 1954 PA 116, MCL 168.1 to 168.992,
4 as if the election had occurred and the candidate had been
5 elected at the election.
6 (3) If the board of a school district cancels an election
7 under subsection (1), the board shall provide reasonable notice
8 of the cancellation to the school electors of the school
9 district.
