A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 20188.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 20188. (1) The governor's commission on patient safety
2 is created in the department of community health. The governor
3 shall appoint the commission on patient safety. The commission
4 on patient safety shall consult with or seek input from the
5 public and from all of the following organizations that have an
6 interest in patient safety:
7 (a) The Michigan hospital association or its successor
8 organization.
9 (b) The Michigan state medical society or its successor
10 organization.
11 (c) The Michigan osteopathic association or its successor
1 organization.
2 (d) The emergency physicians association or its successor
3 organization.
4 (e) The Michigan nurses association or its successor
5 organization.
6 (f) The emergency nurses association or its successor
7 organization.
8 (g) The Michigan association of emergency medical technicians
9 or its successor organization.
10 (h) The Michigan pharmacists association or its successor
11 organization.
12 (i) The Michigan society for clinical laboratory sciences or
13 its successor organization.
14 (j) The Michigan academy of physician assistants or its
15 successor organization.
16 (k) The Michigan society of healthcare risk management or its
17 successor organization.
18 (l) The Michigan association of health plans or its successor
19 organization.
20 (m) The American society of clinical pathologists or its
21 successor organization.
22 (n) The Michigan physical therapy association or its
23 successor organization.
24 (o) The Michigan speech-language-hearing association or its
25 successor organization.
26 (p) The American dietetics association or its successor
27 organization.
1 (q) The national association of social workers, Michigan
2 chapter or its successor organization.
3 (r) The mental health association of Michigan or its
4 successor organization.
5 (s) The Michigan occupational therapy association or its
6 successor organization.
7 (t) Health care association of Michigan or its successor
8 organization.
9 (u) Michigan association for local public health or its
10 successor organization.
11 (v) Michigan hospice and palliative care organization or its
12 successor organization.
13 (w) Michigan society of anesthesiologists or its successor
14 organization.
15 (x) The Michigan home health association or its successor
16 organization.
17 (2) The commission on patient safety shall meet and appoint a
18 chairperson within 30 days after all members are appointed by the
19 governor. Subsequently, the commission shall meet at the call of
20 the chairperson or at the request of a majority of the
21 commission. A majority of the commission constitutes a quorum
22 for the transaction of business. A member of the commission
23 shall serve for a term of 1 year. A vacancy on the commission
24 shall be filled by the governor in the same manner and from the
25 same category as the original appointment.
26 (3) The commission shall review information from other
27 patient safety initiatives and study the causes of medical errors
1 occurring in the continuum of care, including in health
2 facilities and in private practices. Within 1 year after the
3 commission is appointed by the governor, the commission shall
4 issue a written report. The report shall contain recommendations
5 for improvements in medical practice and a system for reducing
6 medical errors, both in health facilities and in private
7 practice.
8 (4) The patient safety commission shall conduct its business
9 at a public meeting of the commission held in compliance with the
10 open meetings act, 1976 PA 267, MCL 15.261 to 15.275. The
11 commission shall give public notice of the time, date, and place
12 of the meeting in the manner required by the open meetings act,
13 1976 PA 267, MCL 15.261 to 15.275.
14 (5) The commission shall make available a writing prepared,
15 owned, used, in the possession of, or retained by the patient
16 safety commission in the performance of an official function to
17 the public in compliance with the freedom of information act,
18 1976 PA 442, MCL 15.231 to 15.246.
