EXECUTIVE BUDGET BILL
A bill to make appropriations for the department of environmental
quality for the fiscal year ending September 30, 2004; to provide for
the expenditure of those appropriations; to create certain funds and
accounts; to require certain reports; to prescribe the powers and
duties of certain state agencies and officials; to authorize certain
transfers by certain state agencies; and to provide for the disposition
of fees and other income received by the various state agencies.

1 Sec. 101. Subject to the conditions set forth in this bill, the

5 PROVISIONS CONCERNING APPROPRIATIONS
7 Sec. 201. Pursuant to section 30 of article IX of the state
8 constitution of 1963, total state spending from state resources under
9 part 1 for fiscal year 2003-2004 is $200,209,300.00 and state spending
10 from state resources to be paid to units of local government for fiscal
11 year 2003-2004 is $16,920,500.00. The itemized statement below
12 identifies appropriations from which spending to units of local
13 government will occur:

23 Sec. 202. The appropriations authorized under this bill are subject
24 to the management and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.
25 Sec. 203. As used in this bill:
26 (a) "CESARS" means chemical evaluation search and retrieval
27 system.
1 (b) "Department" means the department of environmental quality.
2 (c) "DOC" means the United States department of commerce.
3 (d) "DOC-NOAA" means the DOC national oceanic and atmospheric
4 administration.
5 (e) "DOD" means the United States department of defense.
6 (f) "DOI" means the United States department of interior.
7 (g) "EPA" means the United States environmental protection
8 agency.
9 (h) "FEMA" means the federal emergency management agency.
10 (i) "FTE" means full-time equated.
11 (j) "IDG" means interdepartmental grant.
12 (k) "IDT" means intradepartmental transfer.
13 (l) "MDA" means Michigan department of agriculture.
14 (m) "MDCH" means the Michigan department of community health.
15 (n) "MDSP" means the Michigan department of state police.
16 (o) "NPDES" means national pollutant discharge elimination
17 system.
18 Sec. 204. The department of civil service shall bill departments and
19 agencies at the end of the first fiscal quarter for the 1% charge
20 authorized by section 5 of article XI of the state constitution of
21 1963. Payments shall be made for the total amount of the billing by the
22 end of the second fiscal quarter.
23 Sec. 205. (1) A hiring freeze is imposed on the state classified
24 civil service. State departments and agencies are prohibited from
25 hiring any new state classified civil service employees and prohibited
26 from filling any vacant state classified civil service positions. This
27 hiring freeze does not apply to internal transfers of classified
1 employees from 1 position to another within a department.
2 (2) The state budget director shall grant exceptions to the
3 hiring freeze when the state budget director believes that the hiring
4 freeze will result in rendering a state department or agency unable to
5 deliver basic services, cause a loss of revenue to the state, result in
6 the inability of the state to receive federal funds, or necessitate
7 additional expenditures that exceed any savings from maintaining a
8 vacancy. The state budget director shall report quarterly to the
9 chairpersons of the senate and house of representatives standing
10 committees on appropriations the number of exceptions to the hiring
11 freeze approved during the previous quarter and the reasons to justify
12 the exception.
13 Sec. 206. Unless otherwise specified, the department shall use the
14 Internet to fulfill the reporting requirements of this bill. This
15 requirement may include transmission of reports via electronic mail to
16 the recipients identified for each reporting requirement, or it may
17 include placement of reports on an Internet or Intranet site.
18 Sec. 207. From the funds appropriated in part 1 for information
19 technology, the department shall pay user fees to the department of
20 information technology for technology-related services and projects.
21 Such user fees shall be subject to provisions of an interagency
22 agreement between the department and the department of information
23 technology.
24 Sec. 208. Amounts appropriated in part 1 for information technology
25 may be designated as work projects and carried forward to support
26 department of environmental quality projects under the direction of the
27 department of information technology. Funds designated in this manner
1 are not available for expenditure until approved as work projects under
2 section 451a of the management and budget act, 1984 PA 431, MCL
3 18.1451a.
4 Sec. 209. (1) In addition to the funds appropriated in part 1, there
5 is appropriated an amount not to exceed $30,000,000.00 for federal
6 contingency funds. These funds are not available for expenditure until
7 they have been transferred to another line item in this bill under
8 section 393(2) of the management and budget act, 1984 PA 431, MCL
9 18.1393.
10 (2) In addition to the funds appropriated in part 1, there is
11 appropriated an amount not to exceed $5,000,000.00 for state restricted
12 contingency funds. These funds are not available for expenditure until
13 they have been transferred to another line item in this bill under
14 section 393(2) of the management and budget act, 1984 PA 431, MCL
15 18.1393.
16 (3) In addition to the funds appropriated in part 1, there is
17 appropriated an amount not to exceed $100,000.00 for local contingency
18 funds. These funds are not available for expenditure until they have
19 been transferred to another line item in this bill under section 393(2)
20 of the management and budget act, 1984 PA 431, MCL 18.1393.
21 (4) In addition to the funds appropriated in part 1, there is
22 appropriated an amount not to exceed $100,000.00 for private
23 contingency funds. These funds are not available for expenditure until
24 they have been transferred to another line item in this bill under
25 section 393(2) of the management and budget act, 1984 PA 431, MCL
26 18.1393.
27 Sec. 210. (1) In addition to the amounts appropriated in part 1, in
1 order to encourage administrative efficiencies, there is appropriated
2 to the department of environmental quality, an amount not to exceed
3 one-half of the unexpended, unreserved general fund portions of fiscal
4 year 2002-2003 appropriations made to the department for salaries and
5 wages expenses, contractual services, supplies and materials expenses,
6 information technology expenses and program operations costs.
7 (2) The appropriations contained in subsection 1 are subject
8 to the approval of the state budget director and shall be spent for
9 the same purposes for which the original appropriation was made in
10 fiscal year 2002-2003.
11 Sec. 211. (1) The department shall report all of the following
12 information relative to allocations made in part 1 for the
13 environmental cleanup and redevelopment program, state cleanup,
14 emergency actions, superfund cleanup, the revitalization revolving loan
15 program, the brownfield grants and loans program, the leaking
16 underground storage tank cleanup program, the contaminated lake and
17 river sediments cleanup program, and the environmental protection bond
18 projects under section 19508(7) of the natural resources and
19 environmental protection act, 1994 PA 451, MCL 324.19508, to the state
20 budget director, the senate and house appropriations subcommittees on
21 environmental quality, and the senate and house fiscal agencies:
22 (a) The name and location of the site for which an allocation is
23 made.
24 (b) The nature of the problem encountered at the site.
25 (c) A brief description of how the problem will be resolved if
26 the allocation is made for a response activity.
27 (d) The estimated date that site closure activities will be
1 completed.
2 (e) The amount of the allocation, or the anticipated financing
3 for the site.
4 (f) A summary of the sites and the total amount of funds expended
5 at the sites at the conclusion of the fiscal year.
6 (g) The number of sites that would qualify as brownfields that
7 were redeveloped.
8 (2) The report prepared under subsection (1) shall also include
9 all of the following:
10 (a) The status of all state-owned facilities that are on the list
11 compiled under part 201 of the natural resources and environmental
12 protection act, 1994 PA 451, MCL 324.20101 to 324.20142.
13 (b) The report shall include the total amount of funds expended
14 during the fiscal year and the total amount of funds awaiting
15 expenditure.
16 (c) The total amount of bonds issued for the environmental
17 protection bond program pursuant to part 193 of the natural resources
18 and environmental protection act, 1994 PA 451, MCL 324.19301 to
19 324.19306, and bonds issued pursuant to the clean Michigan initiative
20 act, 1998 PA 284, MCL 324.95101 to 324.95108.
21 (3) The report shall be made available by March 31 of each year.
22 Sec. 212. (1) In addition to the funds appropriated in part 1 for
23 the environmental cleanup and redevelopment program and the leaking
24 underground storage tank cleanup program, the department of
25 environmental quality is authorized to expend amounts remaining from
26 prior fiscal year appropriations to meet funding needs of legislatively
27 approved sites.
1 (2) Unexpended and unencumbered amounts remaining from
2 appropriations from the environmental protection bond fund contained in
3 1989 PA 180, 1990 PA 55, 1990 PA 194, 1991 PA 31, 1991 PA 160, 1993 PA
4 74, 1993 PA 353, 1994 PA 442, 1996 PA 353, and 1997 PA 114 are
5 appropriated for expenditure for any site listed in this bill and any
6 site listed in the public acts referenced in this section.
7 (3) Unexpended and unencumbered amounts remaining from
8 appropriations from the cleanup and redevelopment fund and unclaimed
9 bottle deposits fund contained in 1996 PA 319, 1997 PA 113, 1997 PA
10 114, 1998 PA 292, 1999 PA 125, 2000 PA 275, 2001 PA 43, and 2002 PA 520
11 are appropriated for expenditure for any site listed in this bill and
12 any site listed in the public acts referenced in this section.
13 (4) Unexpended and unencumbered amounts remaining from
14 appropriations from the clean Michigan initiative fund - response
15 activities contained in 1999 PA 111, 2000 PA 52, 2000 PA 506, and 2001
16 PA 120 are appropriated for expenditure for any site listed in this
17 bill and any site listed in the public acts referenced in this section.
19 Sec. 301. The unexpended funds appropriated in part 1 for the state
20 cleanup program, environmental cleanup and redevelopment program,
21 emergency cleanup action, contaminated site investigations, cleanup and
22 revitalization, state site cleanup, and superfund cleanup projects are
23 considered work project appropriations and any unencumbered or
24 unallotted funds are carried forward into the succeeding fiscal year.
25 The following is in compliance with section 451a(1) of the management
26 and budget act, 1984 PA 431, MCL 18.1451a:
27 (a) The purpose of the projects to be carried forward is to
1 provide contaminated site cleanup.
2 (b) The projects will be accomplished by contract.
3 (c) The total estimated cost of all projects is identified in
4 each line-item appropriation.
5 (d) The tentative completion date is September 30, 2008.
6 Sec. 302. The unexpended funds appropriated in part 1 for the
7 leaking underground storage tank cleanup program are considered work
8 project appropriations and any unencumbered or unallotted funds are
9 carried over into the succeeding fiscal year. The following is in
10 compliance with section 451a(1) of the management and budget act, 1984
11 PA 431, MCL 18.1451a:
12 (a) The purpose of the projects to be carried over is to provide
13 for redevelopment and contaminated site cleanup.
14 (b) These projects will be accomplished by contract.
15 (c) The total estimated costs of all projects is identified in
16 each line-item appropriation.
17 (d) The tentative completion date for these projects is September
18 30, 2008.
