A bill to amend 1972 PA 382, entitled
"Traxler-McCauley-Law-Bowman bingo act,"
by amending section 5d (MCL 432.105d), as added by 1999 PA 108.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 5d. (1) A qualified organization may apply for an
2 unlimited number of small and large raffle licenses.
3 (2) Only 1 small raffle license may be issued for a location
4 each day.
5 (3) All drawing locations shall be the same if a small raffle
6 license is issued for more than 1 date.
7 (4) A qualified organization is excused from the requirements
8 of obtaining a license under this act if the qualified
9 organization is
sponsoring a single gathering and at which it
10 conducts a raffle,
before which there is no presale of tickets
11 before the gathering, and the total aggregate retail value of the
1 prize or prizes to be awarded that day is $100.00 or less.
2 (5) An organization is not disqualified from obtaining a
3 raffle license if all of the following are true:
4 (a) The organization is a local chapter of a national
5 organization that is exempt from taxation under section 501(c)(3)
6 of the internal revenue code of 1986.
7 (b) There is a state chapter of the national organization
8 described in subdivision (a) in this state that would qualify for
9 the raffle license if the state chapter applied for the license.
10 (c) The organization would qualify for the raffle license but
11 for a time requirement in this act or a rule promulgated under
12 this act that the organization cannot satisfy because the
13 organization has not been in existence for the length of the time
14 requirement.
15 (d) The organization submits a letter of affiliation or a
16 chapter charter with its application for the raffle license
17 showing that subdivisions (a) and (b) apply.
