A bill to amend 1953 PA 181, entitled
"An act relative to investigations in certain instances of the
causes of death within this state due to violence, negligence or
other act or omission of a criminal nature or to protect public
health; to provide for the taking of statements from injured
persons under certain circumstances; to abolish the office of
coroner and to create the office of county medical examiner in
certain counties; to prescribe the powers and duties of county
medical examiners; to prescribe penalties for violations of the
provisions of this act; and to prescribe a referendum thereon,"
by amending section 10 (MCL 52.210).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 10. (1) No
A funeral director, embalmer, or any
2 other person shall not remove the body of any deceased person to
3 a crematory or remove for
the purpose of cremation such the
4 dead body from the county in which death occurred without the
5 signed permit of the county
medical examiner for such county or
6 his or her deputy.
7 (2) If the deceased person is a minor, the funeral director,
1 embalmer, or other person shall not remove the minor's dead body
2 to a crematory or from the county in which the death occurred for
3 the purpose of cremation without the signed permit of the county
4 medical examiner as required under subsection (1) and the written
5 consent of the minor's parent or legal guardian.

person who violates the provisions of this
7 section is guilty of a misdemeanor
and shall be imprisoned
8 felony punishable by imprisonment for not more than 1 year, 5
9 years or fined a
fine of not more than $500.00 $10,000.00, or
10 both.
