A bill to amend 1964 PA 283, entitled
"Weights and measures act,"
by amending section 28c (MCL 290.628c), as added by 2002 PA 208.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 28c. (1) The method of sale of a commodity sold in
2 Michigan shall conform to the "uniform regulation for the method
3 of sale of commodities" published in the 2002 edition of the NIST
4 handbook 130, incorporated by reference, except as otherwise
5 provided in this section or where modified by rule. Section
6 2.20.1 of the uniform regulation for the method of sale of
7 commodities is not adopted.
8 (2) The packaging and labeling requirements for commodities
9 sold in Michigan shall conform to the "uniform packaging and
10 labeling regulation" published in the 2002 edition of the NIST
11 handbook 130, incorporated by reference, except for section 13 of
1 that publication or except as otherwise modified by rule.
2 (3) A certificate of conformance for a type shall comply with
3 the requirements of NCWM publication 14, "national type
4 evaluation program technical policy, checklists and test
5 procedures" and the 2002 edition of the NIST handbook 44,
6 "specifications, tolerances, and other technical requirements for
7 weighing and measuring devices", incorporated by reference.
8 (4) The determination for a uniform basis conformance for a
9 type shall comply with NCWM publication 14, "national type
10 evaluation program technical policy, checklists and test
11 procedures" and the 2002 edition of the NIST handbook 44,
12 "specifications, tolerances, and other technical requirements for
13 weighing and measuring devices", incorporated by reference.
14 (5) The specifications, tolerances, and regulations for
15 commercial weights and measures shall be in compliance with the
16 standards contained in the 2002 edition of the NIST handbook 44,
17 incorporated by reference.
18 (6) Registration for service persons and service agencies and
19 competency tests shall be in compliance with the standards
20 contained in the 2002 edition of the NIST handbook 130, "Uniform
21 regulation for the voluntary registration of service persons and
22 service agencies for commercial weighing and measuring devices",
23 incorporated by reference, and the NIST handbook 44, incorporated
24 by reference.
