                                                                                 A bill to amend 1984 PA 22, entitled                                              

                                                                                

    "Michigan civilian conservation corps act,"                                 

                                                                                

    by amending the title and sections 2, 3, 5, and 11 (MCL 409.302,            

                                                                                

    409.303, 409.305, and 409.311), the title and sections 2 and 3 as           

                                                                                

    amended by 1994 PA 394; and to repeal acts and parts of acts.               

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1                                 TITLE                                         

                                                                                

2                                                                                An act to establish the Michigan civilian conservation                             

                                                                                

3   corps; to prescribe the powers and duties of certain state                  

                                                                                

4   officers, agencies, and departments;  to create and provide for             

                                                                                

5   the use of an endowment fund;  and to provide for an                        

                                                                                

6   appropriation.                                                              

                                                                                

7       Sec. 2.  As used in this act:                                               

                                                                                

8       (a) "Chief" means the chief administrator of the Michigan                   

                                                                                

9   civilian conservation corps appointed pursuant to section 4.                

                                                                                


                                                                                

1       (b) "Commission" means the  Michigan jobs commission                        

                                                                                

2   department of career development or its successor agency.                   

                                                                                

3       (c) "Corps" means the Michigan civilian conservation corps.                 

                                                                                

4       (d) "Corpsmember" means a participant in the corps.                         

                                                                                

5       (e) "Department" means the department of natural resources.                 

                                                                                

6       (f) "Endowment fund" means the Michigan civilian                            

                                                                                

7   conservation corps endowment fund created in section 12a.                   

                                                                                

8       (f)  (g)  "Minority" means a person who is black, hispanic,                 

                                                                                

9   oriental, eskimo, or an American Indian who is not less than 1/4            

                                                                                

10  quantum Indian blood as certified by the person's tribal                    

                                                                                

11  association and verified by the Indian affairs commission.                  

                                                                                

12      (g)  (h)  "Recipient" means a city, village, county,                        

                                                                                

13  township, school district, or intermediate school district of               

                                                                                

14  this state.                                                                 

                                                                                

15      (h)  (i)  "Resident" means an individual who has in this                    

                                                                                

16  state the individual's true, fixed, and permanent home and                  

                                                                                

17  principal establishment to which the individual intends to return           

                                                                                

18  whenever absent.  An individual is a resident until the                     

                                                                                

19  individual establishes a permanent establishment outside this               

                                                                                

20  state.                                                                      

                                                                                

21      Sec. 3.  (1) The Michigan civilian conservation corps is                    

                                                                                

22  established jointly within the department and the commission for            

                                                                                

23  the purpose of  conserving, improving, and developing this                  

                                                                                

24  state's natural resources, and for enhancing, preserving, and               

                                                                                

25  maintaining public lands and waters  conducting activities or               

                                                                                

26  making improvements to enhance publicly owned fish or wildlife              

                                                                                

27  habitat through the employment of residents of this state in work           


                                                                                

1   training programs.  The department may administer on a                      

                                                                                

2   contractual basis a grant program that dispenses funds to                   

                                                                                

3   recipients.                                                                 

                                                                                

4       (2) The work training programs required by this section and                 

                                                                                

5   section 5 shall provide work experience for certain residents of            

                                                                                

6   this state that will increase their likelihood of obtaining                 

                                                                                

7   future employment.                                                          

                                                                                

8       Sec. 5.  (1) Work training programs conducted under this act                

                                                                                

9   shall provide corpsmembers with work experience conducting                  

                                                                                

10  activities or making improvements to enhance publicly owned fish            

                                                                                

11  or wildlife habitat.  related to the conservation, improvement,             

                                                                                

12  or development of natural resources and the enhancement,                    

                                                                                

13  preservation, and maintenance of public lands and waters.  Work             

                                                                                

14  experience may include, but is not limited to, all of the                   

                                                                                

15  following:                                                                  

                                                                                

16      (a) Planting, pruning, and cutting of trees.                                

                                                                                

17      (b) Development of lakes, ponds, and waterways to be used as                

                                                                                

18  hunting and fishing sites and for other recreational purposes.              

                                                                                

19      (c) Wildlife habitat development.                                           

                                                                                

20      (d) Urban parks and recreational site development.                          

                                                                                

21      (e) Trail development.                                                      

                                                                                

22      (f) Flood and drainage control programs, such as the cleaning               

                                                                                

23  and repair of ditches and streams.                                          

                                                                                

24      (g) Prevention of shore and soil erosion.                                   

                                                                                

25      (h) Highway and community beautification.                                   

                                                                                

26      (i) Litter removal.                                                         

                                                                                

27      (j) Assistance in fire prevention and suppression.                          


                                                                                

1       (k) Assistance in times and places of natural disasters.                    

                                                                                

2                                                                                (l) Reclamation of strip-mined land.                                                

                                                                                

3       (m) Insect and pest control.                                                

                                                                                

4       (2) Work training programs shall be undertaken in both urban                

                                                                                

5   and rural areas and shall be selected on the basis of the                   

                                                                                

6   environmental and natural resource  fish or wildlife habitat               

                                                                                

7   benefits each offers, the opportunities for public use each                 

                                                                                

8   offers, and the on the job training value of each.                          

                                                                                

9       (3) Work experience shall not include work on any project for               

                                                                                

10  removal or cleaning up of any toxic waste or other hazardous                

                                                                                

11  substance.                                                                  

                                                                                

12      Sec. 11.  (1) The corps shall assist corpsmembers in                        

                                                                                

13  obtaining employment after their participation in a corps                   

                                                                                

14  program.                                                                    

                                                                                

15      (2) The corps shall ensure that  conservation  programs                     

                                                                                

16  established under this act do not displace currently employed               

                                                                                

17  workers or impair existing contracts for service provided by                

                                                                                

18  other workers, and that no corpsmember is used in any manner in             

                                                                                

19  connection with a work or labor dispute.                                    

                                                                                

20      Enacting section 1.  Section 12a of the Michigan civilian                   

                                                                                

21  conservation corps act, 1984 PA 22, MCL 409.312a, is repealed.              

                                                                                

22      Enacting section 2.  This amendatory act does not take                      

                                                                                

23  effect unless Senate Joint Resolution _____ or House Joint                  

                                                                                

24  Resolution J     (request no. 03106'03) of the 92nd Legislature             

                                                                                

25  becomes a part of the state constitution of 1963 as provided in             

                                                                                

26  section 1 of article XII of the state constitution of 1963.
