A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 11521 (MCL 324.11521).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 11521. (1)
If the owner or operator of a landfill or
2 a municipal solid
waste incinerator knows or should know that
3 solid waste to be
disposed of includes yard clippings that are
4 generated or
collected, or both, on land that is owned by a
5 county, municipality, or
a state facility, the owner or operator
6 of the landfill or
municipal solid waste incinerator shall not
7 accept the solid waste
for disposal.
8 (1) (2)
Beginning on March 28, 1995 Except as otherwise
9 provided in this section, if the owner or operator of a landfill
10 or a municipal solid waste incinerator knows or should know that
11 solid waste to be disposed of includes yard clippings from any
1 source, the owner or operator of the landfill or municipal solid
2 waste incinerator shall not accept the solid waste for disposal.
3 (2) (3)
This section Subsection (1) does not apply to yard
4 clippings that are diseased or infested.
5 (3) Except for Christmas trees and other trees and branches
6 that can be chipped into mulch, the prohibition on the disposal
7 of yard clippings under subsection (1) does not apply from
8 December 1 to March 1 of each year.
