A bill to amend 1939 PA 280, entitled
"The social welfare act,"
(MCL 400.1 to 400.119b) by adding section 111k.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 111k. (1) Beginning January 1, 2006, the department of
2 community health shall ensure that, as a condition of
3 participation and funding, all health professionals, facilities,
4 or health maintenance organizations receiving medicaid payments
5 under this act are in substantial compliance with federal
6 standards for lead screening for children enrolled in medicaid.
7 (2) The department of community health may determine that a
8 health maintenance organization providing lead screening tests to
9 fewer than 80% of children enrolled in the health maintenance
10 organization who are medicaid recipients is not in substantial
11 compliance with federally required standards for lead screening.
1 The department of community health may withhold payment of the
2 costs of the screening test not provided from a payment owed to
3 the health maintenance organization. The department of community
4 health may contract with other community-based agencies or local
5 health departments to provide lead screening tests to the
6 children enrolled in the health maintenance organization who are
7 medicaid recipients.
8 (3) As used in this section, "medicaid" means the program of
9 medical assistance administered by the state under section 105.
