A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 161a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 161a. If an individual is participating in the child
2 support amnesty program established under section 3b of the
3 office of child support act, 1971 PA 174, MCL 400.233b,
4 prosecution shall not be initiated under section 161, 165,
5 167(1)(a), or 167(2) during the amnesty period. If prosecution
6 has been initiated before the individual seeks to participate in
7 the child support amnesty program, the individual is not eligible
8 to participate in the child support amnesty program. A payer who
9 makes full payment of past due support during the amnesty period
10 shall not be prosecuted for failing to pay support due before the
11 start of the amnesty period. This section does not apply after 6
1 months after the effective date of the amendatory act that added
2 this section.
3 Enacting section 1. This amendatory act does not take
4 effect unless House Bill No. 4654 of the 92nd Legislature is
5 enacted into law.
