A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 11514a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 11514a. (1) The owner or operator of a landfill or
2 municipal solid waste incinerator shall inspect each day at least
3 1 load of the solid waste delivered to the disposal area that day
4 and shall inspect each year at least 1% of the loads of solid
5 waste delivered to the disposal area that year.
6 (2) If a load of solid waste is rejected by the owner or
7 operator of a landfill or municipal solid waste incinerator
8 because it contains materials whose disposal at the disposal area
9 is prohibited under this act or rules promulgated under this act,
10 a solid waste hauler shall not subsequently deliver the load to a
11 landfill or municipal solid waste incinerator in this state for
1 disposal unless the solid waste is first processed by a material
2 recovery facility, a transfer station, or other facility that has
3 documented that it has removed from the solid waste those
4 materials that are prohibited from disposal in a landfill or
5 municipal solid waste incinerator under this act or rules
6 promulgated under this act.
7 (3) The owner or operator of a landfill or municipal solid
8 waste incinerator shall promptly report to the department the
9 owner's or operator's rejection of a load of solid waste
10 containing materials whose disposal at that disposal area is
11 prohibited under this act or rules promulgated under this act.
