A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 649 (MCL 257.649).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 649. (1) The driver of a vehicle approaching an
2 intersection shall yield the right of way to a vehicle which has
3 entered the intersection from a different highway.
4 (2) When 2 vehicles enter an intersection from different
5 highways at approximately the same time, the driver of the
6 vehicle on the left shall yield the right of way to the vehicle
7 on the right.
8 (3) The right of way rules declared in subsections (1) and
9 (2) are modified at through highways and otherwise as stated in
10 this chapter.
11 (4) The driver of a vehicle approaching a yield sign, in
1 obedience to the sign, shall slow down to a speed reasonable for
2 the existing conditions and shall yield the right of way to a
3 vehicle in the intersection or approaching on another highway so
4 closely as to constitute an immediate hazard during the time the
5 driver would be moving across or within the intersection.
6 However, if required for safety to stop, the driver shall stop
7 before entering the crosswalk on the near side of the
8 intersection or, if there is not a crosswalk, at a clearly marked
9 stop line; but if there is not a crosswalk or a clearly marked
10 stop line, then at the point nearest the intersecting roadway
11 where the driver has a view of approaching traffic on the
12 intersecting roadway.
13 (5) The driver of
a vehicle traveling at an unlawful speed
14 shall forfeit a right
of way which the driver might otherwise
15 have under this
section.
16 (5) (6) Except
when directed to proceed by a police
17 officer, the driver of a vehicle approaching a stop intersection
18 indicated by a stop sign shall stop before entering the crosswalk
19 on the near side of the intersection, or if there is not a
20 crosswalk shall stop at a clearly marked stop line; or if there
21 is not a crosswalk or a clearly marked stop line, then at the
22 point nearest the intersecting roadway where the driver has a
23 view of approaching traffic on the intersecting roadway. After
24 having stopped, the driver shall yield the right of way to a
25 vehicle which that
has entered the intersection from another
26 highway or which that
is approaching so closely on the highway
27 as to constitute an immediate hazard during the time when the
1 driver would be moving across or within the intersection.
2 (6) (7) When
a vehicle approaches the intersection of a
3 highway from an
intersecting highway or street which that is
4 intended to be, and is constructed as, a merging highway or
5 street, and is plainly marked at the intersection with
6 appropriate merge signs, the vehicle shall yield right of way to
7 a vehicle so close as to constitute an immediate hazard on the
8 highway about to be entered and shall adjust its speed so as to
9 enable it to merge safely with the through traffic.
10 (7) (8) A
person who violates this section is responsible
11 for a civil infraction.
