A bill to provide for the certification of job skills
training programs; to prescribe powers and duties of certain
state departments; and to provide for the promulgation of rules.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. This act shall be known and may be cited as the
2 "job skills training program certification act".
3 Sec. 2. As used in this act:
4 (a) "Department" means the department of labor and economic
5 growth.
6 (b) "Job skills training program" means a course or training
7 program certified by the department as designed to develop,
8 enhance, or upgrade either of the following:
9 (i) Basic skills such as literacy, communication,
10 computational skills, or other transferable workforce skills.
11 (ii) Advanced, specialized, or industry specific skills of an
1 employee that are directly related to the employee's job or
2 career.
3 (c) "Sponsor" means an individual, corporation, limited
4 liability company, partnership, firm, association, public or
5 private agency, educational institution, or other organization
6 that offers a job skills training program.
7 Sec. 3. The department shall certify job skills training
8 programs.
9 Sec. 4. The department shall develop and make available a
10 form for requesting certification of a course or training program
11 under this act. The form shall require all of the following
12 information:
13 (a) A description of the nature of the training, instruction,
14 and curricula that the course or training program provides to
15 participants.
16 (b) The career fields or job classifications for which an
17 advanced, specialized, or industry specific course or training
18 program prepares the participants.
19 (c) The duration of the course or training program.
20 (d) A description of any certification, license, or degree
21 that the participants may earn by successfully completing the
22 course or training program.
23 (e) The amount of any fee or tuition charged for the course
24 or training program.
25 (f) A description of the sponsor's experience conducting the
26 course or training program for which certification is sought or
27 conducting other courses or training programs.
1 Sec. 5. The department may require 1 or more of the
2 following as a condition for certification:
3 (a) Certification by, accreditation by, or good standing in
4 an appropriate accrediting organization.
5 (b) Payment of a certification or renewal fee in an amount
6 not greater than the department's costs of conducting the
7 certification procedure.
8 (c) Other information, demonstrations, or reports that the
9 department considers necessary or appropriate to enable the
10 department to determine whether or not a course or training
11 program meets, or continues to meet, statutory requirements for
12 certification as a job skills training program.
13 Sec. 6. The department may promulgate rules under the
14 administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to
15 24.328, as necessary to establish the procedure, requirements, or
16 standards for certification of job skills training programs.
17 Enacting section 1. This act does not take effect unless
18 all of the following bills of the 92nd Legislature are enacted
19 into law:
20 (a) Senate Bill No. _____ or House Bill No. 6080 (request

22 (b) Senate Bill No. _____ or House Bill No. 6081 (request
23 no. 04341'03).
