                                                                                 A bill to amend 1917 PA 167, entitled                                             

                                                                                

    "Housing law of Michigan,"                                                  

                                                                                

    (MCL 125.401 to 125.543) by adding section 82a.                             

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 82a.  (1) Each dwelling unit contained within a class                  

                                                                                

2   "A" multiple dwelling shall be equipped with a fire alarm system            

                                                                                

3   that complies with the standards set forth in section 1 and                 

                                                                                

4   section 101 of the national fire prevention code published by the           

                                                                                

5   national fire prevention association, incorporated by reference             

                                                                                

6   herein.                                                                     

                                                                                

7       (2) A class "A" multiple dwelling constructed before the                    

                                                                                

8   effective date of the amendatory act that added this section has            

                                                                                

9   1 year after the effective date of the amendatory act that added            

                                                                                

10  this section to comply with subsection (1).                                 

                                                                                

11      (3) An existing building that is converted to a class "A"                   

                                                                                


                                                                                

1   multiple dwelling after the effective date of the amendatory act            

                                                                                

2   that added this section shall comply with subsection (1) subject            

                                                                                

3   to the requirements that may be imposed by the                              

                                                                                

4   Stille-DeRossett-Hale single state construction code act, 1972 PA           

                                                                                

5   230, MCL 125.1501 to 125.1531.                                              

                                                                                

6       (4) A person owning or managing a class "A" multiple dwelling               

                                                                                

7   shall comply with this section.                                             

                                                                                

8       (5) A person who violates this section is guilty of a                       

                                                                                

9   misdemeanor punishable by a fine of not more than $500.00 or                

                                                                                

10  imprisonment of not more than 90 days, or both.                             

                                                                                

11      (6) As used in this section:                                                

                                                                                

12      (a) "Dwelling unit" means 1 or more rooms used by 1 or more                 

                                                                                

13  individuals living together as a single housekeeping unit                   

                                                                                

14  containing cooking, living, sanitary, and sleeping facilities.              

                                                                                

15      (b) "Fire alarm system" means a system designed to detect and               

                                                                                

16  annunciate the presence of fire or by-products of fire.  Fire               

                                                                                

17  alarm system includes smoke detectors.  A fire alarm system may             

                                                                                

18  be any of the following:                                                    

                                                                                

19                                                                               (i) Battery operated by a self-motivated battery.                                   

                                                                                

20      (ii) Operated in a plug-in outlet that is fitted with a plug                 

                                                                                

21  restrainer device, provided the outlet is not controlled by a               

                                                                                

22  switch other than the main electric power supply.                           

                                                                                

23      (iii) Wired directly to the building electric supply and not                 

                                                                                

24  controlled by a switch other than the main electric power supply.
