A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 11507a (MCL 324.11507a), as added by 1996 PA
359.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 11507a. (1) The owner or operator of a landfill shall
2 annually submit a report
to the state and department and to the
3 county and municipality in which the landfill is located that
4 contains information
on the amount of solid waste received by
5 the landfill during
the year itemized, to the extent possible, by
6 county, state, or
country of origin. all of the
following
7 information:
8 (a) Each county of this state, each state, and each country
9 from which originated solid waste received by the landfill during
10 the year.
1 (b) The total amount of solid waste received by the landfill
2 during the year and, to the extent possible, the amount
3 originating from each county, state, or country identified under
4 subdivision (a).
5 (c) Whether the landfill will establish, or maintain, and
6 enforce a landfill policy that prohibits receiving waste from any
7 other state or country in the following year.
8 (2) By September 1, 1996, the department shall develop and
9 submit to the
legislature a plan to gather data on the amount of
10 recyclable materials
recovered in the state itemized, to the
11 extent possible, by
county, state, or country of origin. If
a
12 landfill reports that it will enforce a policy described in
13 subsection (1)(c), the landfill shall make a reasonable effort to
14 enforce the policy.
15 (3) The department shall annually compile a list of
16 landfills that report they will enforce a policy described in
17 subsection (1)(c). The department shall publish the list, post
18 the list on its website, and make the list available to any
19 person upon request.
20 (4) A department or agency of this state; a city, village,
21 or township; a school district or intermediate school district;
22 or an authority created pursuant to state law shall not enter
23 into a contract for the disposal of solid waste unless the solid
24 waste will be disposed of at a landfill that, at the time the
25 contract is entered into, is on the list described in subsection
26 (3).
27 (5) The director may promulgate rules to implement this
