A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 80115 (MCL 324.80115), as added by 1995 PA
58, and by adding section 80124b.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 80115. (1) The revenue received under this part shall
2 be deposited in the state treasury. The revenue division,
3 department of treasury, shall annually present to the department
4 an accurate total of all the revenues collected, and shall then,
5 except as provided in section 80124b, credit the revenues
6 collected to the following funds:
7 (a) 17.5% to the Michigan state waterways fund created in
8 section 78110.
9 (b) 33.5% to the Michigan harbor development fund created in
10 section 78110.
1 (c) 49% to the marine safety fund created in subsection (2).
2 (2) The marine safety fund is created as a separate fund in
3 the state treasury. The legislature shall appropriate from the
4 marine safety fund for water safety education programs and for
5 the administration and enforcement of this part, including state
6 aid to counties, and for no other purpose, but not in excess of
7 revenues credited to the
marine safety fund. No portion of the
8 fees Fees provided for in section 80124 shall not
be
9 appropriated for the inspection of vessels that carry passengers
10 for hire and are regulated under part 445.
11 Sec. 80124b. (1) Money received by the secretary of state
12 from the sale of each Great Lakes protection specialty watercraft
13 decal under section 80124a shall be used as follows:
14 (a) $10.00 shall be retained by the secretary of state as
15 reimbursement for the cost of creating and distributing the
16 decals.
17 (b) Except as otherwise provided in this subdivision, $25.00
18 shall be forwarded to the state treasurer for deposit into the
19 Michigan Great Lakes protection fund to be used for public
20 education on the threat of aquatic nuisance species and efforts
21 to eradicate aquatic nuisance species from the Great Lakes and
22 other waters of the state. The secretary of state may sell
23 decals that are valid for less than 3 years, in which case the
24 secretary of state shall prorate the portion of the cost of the
25 decal that is to be deposited in the Michigan Great Lakes
26 protection fund.
27 (2) The secretary of state may establish the appropriate
1 placement of Great Lakes protection specialty watercraft decals
2 on watercraft so as not to create confusion for law enforcement
3 officers with decals required under section 80124.
4 (3) As used in this section:
5 (a) "Aquatic nuisance species" means that term as it is
6 defined in section 3101.
7 (b) "Michigan Great Lakes protection fund" means the Michigan
8 Great Lakes protection fund created in section 32905.
9 Enacting section 1. This amendatory act does not take
10 effect unless Senate Bill No. 536
11 of the 92nd Legislature is enacted into
12 law.
