A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 9123 (MCL 324.9123), as amended by 2000 PA
504.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 9123. (1) Beginning
3 years after the effective date
2 of the 2000 amendments
to this section, each Each
individual who
3 is responsible for administering this part and the rules
4 promulgated under this part or a local ordinance and who has
5 decision-making authority for soil erosion and sedimentation
6 control plan development or review, inspections, permit issuance,
7 or enforcement shall be trained by the department. The
8 department shall issue a
certificate of training to individuals
9 an individual under this
section if they do the individual does
10 both of the following:
1 (a) Complete Completes
a soil erosion and sedimentation
2 control training program sponsored by the department.
3 (b) Pass Passes
an examination on the subject matter
4 covered in the training program under subdivision (a).
5 (2) A certificate of training under subsection (1) is valid
6 for 5 years. For
recertifications, the department may offer a
7 refresher course or
other update in lieu of the
requirements of
8 subsection (1)(a) and (b), the department shall offer a refresher
9 course or other update or shall approve continuing education
10 training offered by other qualified organizations.
11 (3) The department may charge fees for administering the
12 training program and the examination and any refresher course or
13 update under this section that are not greater than the
14 department's cost of
administering the training program and the
15 examination these activities. All fees collected under
this
16 section shall be deposited into the soil erosion and
17 sedimentation control training fund created in section 9123a.
