A bill to amend 1939 PA 3, entitled
"An act to provide for the regulation and control of public
utilities and other services affected with a public interest
within this state; to provide for alternative energy suppliers;
to provide for licensing; to include municipally owned utilities
and other providers of energy under certain provisions of this
act; to create a public service commission and to prescribe and
define its powers and duties; to abolish the Michigan public
utilities commission and to confer the powers and duties vested
by law on the public service commission; to provide for the
continuance, transfer, and completion of certain matters and
proceedings; to abolish automatic adjustment clauses; to prohibit
certain rate increases without notice and hearing; to qualify
residential energy conservation programs permitted under state
law for certain federal exemption; to create a fund; to provide
for a restructuring of the manner in which energy is provided in
this state; to encourage the utilization of resource recovery
facilities; to prohibit certain acts and practices of providers
of energy; to allow for the securitization of stranded costs; to
reduce rates; to provide for appeals; to provide appropriations;
to declare the effect and purpose of this act; to prescribe
remedies and penalties; and to repeal acts and parts of acts,"
(MCL 460.1 to 460.10cc) by adding section 10gg.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 10gg. (1) Not later than 30 days after the effective
1 date of the amendatory act that added this section, each electric
2 utility shall file a tariff to provide schools receiving electric
3 service at secondary voltage levels the ability to purchase
4 electric power and energy from the electric utility at a rate 20%
5 lower than the electric utility's otherwise applicable tariff in
6 effect on the effective date of the amendatory act that added
7 this section.
8 (2) Schools receiving electric service at primary voltages
9 and above shall have the ability to purchase electric power and
10 energy from the electric utility at a rate 10% lower than the
11 electric utility's otherwise applicable tariff in effect on the
12 effective date of the amendatory act that added this section.
13 (3) The commission shall approve the tariff within 60 days of
14 the date the electric utility filed its tariff. The commission
15 shall not adopt any rate-making adjustment that disallows
16 recovery of, or otherwise imputes the amount of revenue
17 attributable to, the rates for electric service to schools
18 provided for in this section.
19 (4) As used in this section, "school" means buildings,
20 facilities, playing fields, or property directly or indirectly
21 used for school purposes for children in grades kindergarten
22 through 12, when provided by a public or nonpublic school.
23 School does not include instruction provided in a private
24 residence or proprietary trade, vocational, training, or
25 occupational school.
26 Enacting section 1. This amendatory act does not take
27 effect unless all of the following bills of the 92nd Legislature
