                                                                                 A bill to amend 1936 (Ex Sess) PA 1, entitled                                     

                                                                                

    "Michigan employment security act,"                                         

                                                                                

    by amending the title and section 5b (MCL 421.5b), the title as             

                                                                                

    amended by 1991 PA 10, and section 5b as added by 2002 PA 192.              

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1                                 TITLE                                         

                                                                                

2                                                                                An act to protect the welfare of the people of this state                          

                                                                                

3   through the establishment of an unemployment compensation fund,             

                                                                                

4   and to provide for the disbursement thereof; to create certain              

                                                                                

5   other funds; to create the  Michigan employment security                    

                                                                                

6   commission  unemployment insurance agency, and to prescribe its             

                                                                                

7   powers and duties; to provide for the protection of the people of           

                                                                                

8   this state from the hazards of unemployment; to levy and provide            

                                                                                

9   for contributions from employers; to provide for the collection             

                                                                                

10  of such contributions; to enter into reciprocal agreements and to           

                                                                                


                                                                                

1   cooperate with agencies of the United States and of other states            

                                                                                

2   charged with the administration of any unemployment insurance               

                                                                                

3   law; to furnish certain information to certain governmental                 

                                                                                

4   agencies for use in administering public benefit and child                  

                                                                                

5   support programs and investigating and prosecuting fraud; to                

                                                                                

6   provide for the payment of benefits; to provide for appeals from            

                                                                                

7   redeterminations, decisions, and notices of assessments;  and  to           

                                                                                

8   provide for referees and a board of review to hear and decide the           

                                                                                

9   issues arising from redeterminations, decisions, and notices of             

                                                                                

10  assessment; to provide for the cooperation of this state and                

                                                                                

11  compliance with the provisions of the social security act and the           

                                                                                

12  Wagner-Peyser act passed by the Congress of the United States of            

                                                                                

13  America; to provide for the establishment and maintenance of free           

                                                                                

14  public employment offices; to provide for the transfer of funds;            

                                                                                

15  to make appropriations for carrying out the provisions of this              

                                                                                

16  act; to prescribe remedies and penalties for the violation of the           

                                                                                

17  provisions of this act; and to repeal all acts and parts of acts            

                                                                                

18  inconsistent with the provisions of this act.                               

                                                                                

19      Sec. 5b.  (1) The  bureau of worker's and unemployment                      

                                                                                

20  compensation  unemployment insurance agency is created within the           

                                                                                

21  department of  consumer and industry services  labor and economic           

                                                                                

22  growth.                                                                     

                                                                                

23      (2) The  bureau  agency shall be headed by a director.  who                 

                                                                                

24  shall be appointed by the governor.                                         

                                                                                

25      (3) All of the authority, powers, functions, duties, and                    

                                                                                

26  responsibilities of the unemployment agency provided under this             

                                                                                

27  act are transferred to the  bureau  unemployment insurance agency           


                                                                                

1   as provided in Executive Order No.  2002-1  2003-18.                        

                                                                                

2       (4) All of the powers, functions, duties, and                               

                                                                                

3   responsibilities of the director of the unemployment agency,                

                                                                                

4   defined as the director of employment security in Executive Order           

                                                                                

5   No. 1997-12, provided under this act are transferred to the                 

                                                                                

6   director of the unemployment insurance agency as provided in                

                                                                                

7   Executive Order No.  2002-1  2003-18.                                       

                                                                                

8       Enacting section 1.  This amendatory act does not take                      

                                                                                

9   effect unless all of the following bills of the 92nd Legislature            

                                                                                

10  are enacted into law:
