A joint resolution proposing an amendment to the state
constitution of 1963, by amending section 54 of article IV, to
modify term limits for certain elected state offices.
Resolved by the Senate and House of Representatives of the
state of Michigan, That the following amendment to the state
constitution of 1963, to modify term limits for certain elected
state offices, is proposed, agreed to, and submitted to the
people of the state:
1 ARTICLE IV
2 Sec. 54. No person
shall be elected to the office of
3 serve as a state
representative more than three times. No
4 person shall be
elected to the office of state senate more than
5 two times or state senator for a combined total of more than

6 years. Any person appointed or elected to fill a vacancy in the
7 house of representatives
or the state senate for a period
1 greater than one half
of a term of such office, who holds
office
2 for one day or more within a calender year shall be considered to
3 have been elected to
serve one time in that office served the
4 entire calendar year for purposes of this section. This
5 limitation on the number
of times years a person shall be
6 elected to may serve in office shall apply to terms of
office
7 beginning on or after January 1, 1993. A person is not eligible
8 to serve as a state representative or state senator unless that
9 person is eligible to serve the entire term of that office under
10 this section.
11 This section shall be self-executing. Legislation may be
12 enacted to facilitate operation of this section, but no law shall
13 limit or restrict the application of this section. If any part
14 of this section is held to be invalid or unconstitutional, the
15 remaining parts of this section shall not be affected but will
16 remain in full force and effect.
17 Resolved further, That the foregoing amendment shall be
18 submitted to the people of the state at a special election to be
19 held on March 2, 2004 in the manner provided by law.
