A SUMMARY OF HOUSE BILL 4025 AS REPORTED FROM COMMITTEE
Under the Revised Judicature Act, a person appointed as a magistrate must, among other requirements, file a bond with the county treasurer in the county in which he or she is appointed. Magistrates serve at the pleasure of district court judges. House Bill 4025 would amend the act to require that the bond be filed, instead, with the treasurer of a local funding unit in the district. Currently, the bond applies to temporary service in another county when such service is authorized. The bill would include service in another county under a multiple district plan. The bill would apply to bonds filed or renewed by district court magistrates after December 31, 2005.
