A SUMMARY OF HOUSE BILL 5337 AS INTRODUCED 10-19-05
The bill would amend the Michigan Military Act to treat administrative hearings in the same manner as lawsuits for officers and enlisted personnel on active state service in support of civilian authority or in time of war or emergencies. Currently, the act says that suits in the state's courts pending against these military personnel "stand adjourned until after the termination of the service." Under the bill, administrative hearings in the state would also stand adjourned.
The section of the act being amended, generally speaking, provides military personnel with protection against arrest and imprisonment, protection for their property from seizure or attachment for debts, and protection against utility shut-offs.
FISCAL IMPACT:
The bill would have no fiscal impact on state or local government.
