A SUMMARY OF HOUSE BILL 5811 AS INTRODUCED 3-1-06

The bill would amend the Home Solicitation Sales Act to provide an exemption for alternative gas suppliers or alternative electric suppliers from a section that requires a buyer's signature to a written agreement or offer to purchase and that designates the date the buyer actually signs as the date of the transaction.

House Bill 5811 would provide an exemption specifically for a home solicitation sale of natural gas or electricity if the seller is an alternative gas supplier or alternative electric supplier licensed by the [Public Service] Commission and the sale is the result of a telephone solicitation.

[The section being amended describes the form and contents of a written agreement or offer to purchase, including a statement about the ability of the buyer to cancel the transaction at any time prior to midnight of the third business day after the date of the transaction.  Until a seller has complied with the signature requirement, the buyer can cancel the home solicitation sale at any time.]
