COMMUNITY COLLEGE ELECTIONS S.B. 515: COMMITTEE SUMMARY

Senate Bill 515 (as introduced 5-19-05)
Sponsor: Senator Nancy Cassis
Committee: Government Operations
Date Completed: 5-24-05
CONTENT
The bill would amend the Community College Act to delete provisions pertaining to regular community college elections and nominating petitions and filing deadlines for candidates for community college boards. The bill specifies that candidates for the office of member of a community college board would be nominated and elected as provided under the Michigan Election Law.
Elections
The Act requires the regular community college election to be held at the same time as the regular school elections of the constituent school districts on the day determined under Section 462 of the Michigan Election Law (which provides for the scheduling of school districts' regular elections). If any component school district holds its annual school election on a different date, the board of that district must call a special election to be held on the same day as prescribed by this provision. The bill would delete these requirements.
The bill also would delete a provision that a regular community college election is held at the same time as the regular school election. Under that provision, a constituent county must call a special election to be held on the date of the regular school election.
The Act provides that, at the regular elections, separate propositions may be submitted to the electors in addition to the election of trustees of the community college district, when authorized by the board of trustees. Under the bill, this would apply to a regular community college election.
Candidate Nomination & Filing
The bill would delete provisions of the Community College Act that govern the nomination of candidates and the filing deadline for candidates for members of community college boards. The bill would require that a candidate for the office of member of a community college board be nominated, and members elected, as provided in Chapter XIV (School and Community College Elections) of the Michigan Election Law (MCL 168.301-168.315).
