Changes from FY 2005-06 Year-to-Date:
  1. New Employee Schools. The Governor proposed training 695 new corrections officers. Training includes the cost of a corrections officers initial clothing issue, salary for the training, and training materials. As training functions are now consolidated with the Michigan State Police, the Governor also provided funding to pay the MSP for meals, room usage, security, and lodging costs. The Senate concurred. 8,824,400
2. Health Care. The Governor added $457,300 for additional Nurse Practitioners for acute case review, $1,018,800 for compliance with the Hadix consent decree, $471,400 to the DOJ psychiatric consent decree for a new Department of Community Health Mental Health Outpatient Team at the Thumb Correctional Facility (TCF), and $331,500 for additional clinical staffing at TCF. 3. Information Technology. The Governor recommended $1,098,700 to replace the current servers housing the Offender Management Network Information (OMNI) system, and $660,000 for completing the migration of the Department's older database, CMIS, to the new OMNI application. The Senate concurred. 1,758,700
4. GPS Electronic Tethers. The Governor proposed implementing Global Positioning System (GPS) tethers to passively monitor parolees who have committed serious criminal violations and have high rates of recidivism. Target offender groups include burglars and sex offenders. The Senate concurred. 1,670,500
5. Jail Capacity Grants. The Governor removed funding for county jail capacity grants, which will not be used because expected statute changes were not made in the sentencing guidelines. The Senate concurred. (4,000,000)
6. Corrections Security Inspectors. The Governor reduced the number of Inspectors at correctional facilities to one per facility. The Senate concurred. (1,500,000)
7. Jail Services. The Governor restored funding for the Jail Services Unit, which was not moved to the Department of Labor and Economic Growth because expected statue changes were not made. The Senate concurred. 612,000
8. Equipment and Special Maintenance. The Governor reduced funding for equipment and special maintenance and replaced it in Capital Outlay. The Senate concurred. (2,000,000)
9. Sheriff's Coordinating and Training Office. The Governor aligned funding with actual collections, which were less than $130,000 in FY 2004-05. The Senate concurred. (1,500,000)
10. Efficiencies. The Governor recognized a savings of $2,731,000 for Field Operations due to the implementation of a reorganization plan. Egeler Correctional Facility also achieved organizational efficiencies for a reduction of $268,700. The Senate concurred. (2,999,700)
11. Economic Adjustments. The Governor recommended increases for salaries, insurances, retirement, building occupancy charges, food, and fuel as well as savings in workers compensation. The Senate concurred. 84,026,400
12. Other Changes. The Governor proposed other changes, resulting in a net increase. The Senate concurred. 143,800

Changes from FY 2005-06 Year-to-Date :
  1. Retained Sections. The Senate retained the following sections, which the Governor proposed to delete: ????* ???Section 206 - Prohibits disciplinary action against any employee for communicating with a legislator. ????* ???Section 207 - Requires plans 120 days prior to start of a privatization initiative and evaluation within 30 months. ????* ???Section 606 - Requires the DOC to revise parole agent/parolee contact to protect agent personal information. ????* ???Section 903 - Requires timely payment to local ambulance service providers. ????* ???Section 904 - Encourages the DOC to identify and manage prisoners who abuse off-site medical services.
* ???Section 907 - Requires that prisoner prescription medications follow prisoners when they are transferred. * ???Section 1010 - Requires that DOC maintain the Braille transcribing service at its current location in Jackson. ????* ???Section 1011(1) - Ensures a sufficient number of custody staff to maintain the safety and security of facilities. ????* ???Reporting Requirements - Reports on the collection and expenditure of all restricted revenues (213), correctional facility staffing ratios (403), offenders who served their maximum sentence and have been released (408), health care services and payments (902(1)), academic/vocational programs (1007(1)), prisoner educational status and impact of vocational education on recidivism (1008), and critical incidents and assaults (1011(2)). ????* ???Legislative Intent - Intent that the DOC purchase produce from Michigan growers and producers (212), the DOC work with the AG and local law enforcement in assigning the field agents for Project Joshua (607(2)), local health care providers have the opportunity to bid on future managed care contracts (902(2)), and enough nurses be hired to limit overtime (908).
2. Deletions. The Senate concurred with the Governor in deleting the following sections: * ???Section 407(1) - Requires that the DOC continue the reentry programs at Cooper Street, Huron Valley, and Macomb.
* ???Section 1014 - Requires the removal of male staff from housing units in female facilities, designation of someone in each facility to ease the complaint process, and referral of all claims of criminal conduct to the MSP. * ???Reporting Requirements - Reports on the expansion of MSI into the private textile market (410), mental health and substance abuse services with DCH (504), and youth in the juvenile and adult corrections systems (511). * ???Legislative Intent - Intent that the DOC provide at least one voluntary cognitive restructuring program (1008), and Supplementary Operation Expenditures be used for salary increases, dry cleaning allowances, and jail capacity grants (1015).
3. Contingency Fund Language. The Governor added contingency fund transfers. The Senate deleted. (Sec. 213)
4. Deprived and Depressed Communities. The Governor added language encouraging the DOC to contract with businesses in deprived and depressed communities. The Senate concurred. (Sec. 217)
5. Budget Reductions. The Senate required a report on general fund budget cuts that will be sufficient to reduce DOC spending if the K-16 ballot initiative is adopted. (Sec. 218)
6. Population Projections. The Governor postponed the population projection report due date from February 1 to February 15. The Senate retained the original due date. (Sec. 401)
7. MPRI Status Reports. The Governor changed the monthly reports on the status of released offenders who participated in the MPRI to annual reports due April 1. The Senate changed to quarterly reports. (Sec. 406(2))
8. Recidivism Rates. The Governor deleted language providing for reports in subsequent years and deleted some language regarding what must be included in the recidivism rates report. The Senate kept language regarding what must be included in the report. (Sec. 409)
9. Assaultive Offender Program. The Governor deleted a requirement for a statewide waiting list and program placement prior to parole eligibility. The Senate retained and added that the section shall not deem parole denial appealable in court. (Sec. 504)
10. Parole Agent Caseload Report. The Governor deleted a report on parole and probation agent workloads. The Senate retained the report and added that the report must include the projected workloads for the next fiscal year. (Sec. 605(1))
11. GPS Tether Program Report. The Senate required a report on the failure rate of parolees involved with the GPS electronic tether program. (Sec. 608)
12. Hepatitis C. The Senate added language stating that the DOC shall cooperate with DCH to share information related to inmates and Hepatitis C, and required a report on the results of its work on this section. (Sec. 909)
13. Smoking Areas. The Governor deleted language requiring designated smoking areas for prisoners and staff except within 20 feet of each facility. The Senate retained the section but removed the prohibition for areas within 20 feet of each facility, and exempted areas that house prisoners with medical needs from having smoking areas. (Sec. 1001)
14. Prisoner Education Program Report. The Senate required a report on the DOC's status of compliance with the findings of the 2005 Performance Audit of the Prisoner Education Program by the Office of the Auditor General. (Sec. 1007(2))
15. Restriction on Capacity Changes. The Senate added language prohibiting the DOC from reopening or operating previously closed prison facilities or expanding the capacity of existing facilities not already included in the budget, until the vacant prison beds in the Michigan Youth Correctional Facility are utilized. (Sec. 1012)
16. Prisoner Store Surcharge. The Senate imposed a 35% surcharge on all goods sold in prisoner stores, with the revenue directed toward the MSP trooper recruit school and the MSP retirement system. (Sec. 1013)
