CHILD PROTECTION: METH EXPOSURE S.B. 1118: COMMITTEE SUMMARY

Senate Bill 1118 (as introduced 3-2-06)
Sponsor: Senator Bev Hammerstrom
Committee: Families and Human Services

Date Completed: 3-14-06

CONTENT
The bill would amend the Child Protection Law to require the Department of Human Services to file a petition for juvenile court jurisdiction in child abuse cases involving methamphetamine production.

Under the Law, the Department must petition the court if it determines that a parent, guardian, or custodian, or a person who is 18 or older and resides for any length of time in the child's home, has abused the child or a sibling of the child and the abuse included any of the circumstances listed in the Law (e.g., criminal sexual conduct; battering, torture, or severe physical abuse; or murder). Under the bill, the Department also would have to petition the court if the abuse involved causing the child to be exposed to or to have contact with methamphetamine production.

FISCAL IMPACT
The bill would have no fiscal impact on State or local government. The change apparently would codify existing practice of the Department of Human Services.
