COLES CERTIFICATION H.B. 4335 (H-2): FLOOR ANALYSIS
House Bill 4335 (Substitute H-2 as reported without amendment)
Sponsor: Representative Gary Newell
House Committee: Judiciary
Senate Committee: Judiciary
CONTENT
The bill would amend the Commission on Law Enforcement Standards Act to specify that a Commission-certified law enforcement officer who was a member of any of the "reserve components of the United States armed forces" and who was called to active duty in the armed forces would not be considered to have discontinued his or her employment as a certified law enforcement officer. The person's certification would not become void during the term of active military service. If the person committed an offense that resulted in a felony conviction during that period, however, his or her certification could be revoked.
(Under the Act, a person's certification becomes void when he or she discontinues his or her employment as a Commission-certified law enforcement officer.)
The bill specifies that it would not apply to a certified law enforcement officer who volunteered for a term of active military service or who voluntarily extended a term of active military service that began when he or she was called to active duty. It also would not apply to a certified law enforcement officer who was dishonorably discharged from a term of active military service.
"Reserve components of the United States armed forces" would mean that term as defined in the Military Family Relief Fund Act, i.e., the U.S. Army National Guard; the Army, Naval, Marine Corps, Air Force, and Coast Guard reserves; and the U.S. Air National Guard.
