RELEASE OF ACCIDENT INFORMATION H.B. 4889 (S-1): FLOOR ANALYSIS

CONTENT
The bill would amend the Michigan Vehicle Code to expand the types of personnel whose job-related accident and driving records may not be released by the Department of State, and allow those records to be released if the person were convicted of a crime in connection with the accident.


Currently, the Department may not release to a nongovernmental agency information relating to an accident on the record of police officer, fire-fighter, or person authorized to operate an ambulance or other emergency vehicle, if the accident occurred while the person was operating the vehicle during the course of his or her employment.


The bill would extend this to an employee of the Michigan Department of Transportation, a county road commission, or a local authority having jurisdiction over a highway who is authorized to operate a motor vehicle or equipment while working within the highway right-of-way.


The bill provides that the prohibition would not apply to a person described above who was convicted of a crime under the Code in connection with the accident.


The bill would take effect on October 1, 2010.
