CONTENT
The bill would amend Public Act 153 of 1975 (which deals with marketing fees for purchasers of fruits and vegetables) to allow, rather than require, the Michigan Department of Agriculture (MDA) to promulgate administrative rules.
Under the Act, the MDA must promulgate rules pursuant to the Administrative Procedures Act. The bill would allow the MDA to promulgate such rules.
The bill also would require the Office of Administrative Hearings and Rules, rather than the MDA Director, to appoint hearing officers to hear complaints of violations of the Act.
