CONTENT
The bill would amend the Motor Carrier Safety Act to define the term "medical examiner" as it is defined under Federal motor carrier safety regulations for purposes related to the physical qualifications of commercial motor vehicle (CMV) operators.


Under the Act, a person who is not physically qualified to drive a CMV according to Federal regulations, but is otherwise qualified, may apply for a waiver from the Motor Carrier Division of the State Police or the Motor Carrier Safety Appeal Board. A waiver application must include specified information and be accompanied by at least two reports of medical examinations conducted by a medical examiner.


Under the bill, "medical examiner" would mean that term as defined in 49 CFR 390.5, i.e., a person who is licensed, certified, and/or registered, in accordance with applicable state laws and regulations, to perform physical examinations. The term includes doctors of medicine, doctors of osteopathy, physician assistants, advanced practice nurses, and doctors of chiropractic.
