CONTENT
The bill would amend the Michigan Military Act to require the adjournment of all intermediate hearings in lawsuits pending against officers and enlisted personnel on active service, or commenced during that service, until the end of their service.
Under the Act, officers and enlisted personnel on active service longer than seven days and when ordered to service by the Governor in support of civilian authority or in time of war or State or national emergency, are privileged from arrest and imprisonment in all cases, except for treason, felony, or breach of the peace, during the time of service and for six months after the service ceases. In addition, suits in Michigan courts pending against any such person when he or she enters active service, or commenced at any time during the service, stand adjourned until after the termination of the service. Under the bill, the provision that suits stand adjourned while the person is in active service would include all intermediate hearings in the suits.
