VILLAGE ELECTION FILING DEADLINE H.B. 5813: COMMITTEE SUMMARY
House Bill 5813 (as passed by the House)
Sponsor: Representative Chris Ward
House Committee: House Oversight, Elections, and Ethics
Senate Committee: Government Operations
Date Completed: 3-21-06
CONTENT
The bill would amend the Michigan Election Law to require that nominating petitions for village offices be filed with the appropriate township clerk by 4 p.m. on the 12th Tuesday before the general November election, unless a village council had adopted a resolution to hold its regular election at the September primary election. After a nominating petition was filed for a candidate for a village office, the candidate would not be permitted to withdraw unless a written withdrawal notice, signed by the candidate, was filed with the appropriate township clerk by 4 p.m. of the third day after the last day for filing the nominating petition.
Under the Act, filing for a village office must be with the township clerk if the township is conducting the election or, if the village is located in more than one township, with the township in which the largest number of registered electors of the village reside.
