CONTENT
The bill would amend the Michigan Liquor Control Code to allow proof that a defendant was shown a military identification card, as a defense to an action for the sale of liquor to a minor.
Under the Code, a person who knowingly sells or furnishes alcoholic liquor to a minor (a person under 21 years old), or who fails to make diligent inquiry as to whether the person is a minor, is guilty of a misdemeanor. In an action for a violation, proof that the defendant or the defendant's agent or employee demanded and was shown, before furnishing alcoholic liquor to a minor, a motor vehicle operator's or chauffeur's license, a registration certificate issued by the Federal Selective Service, or other bona fine documentary evidence of the age and identity of the person, is a defense to the action. The bill would refer to a military identification card, rather than a Selective Service registration certificate.
