CONTENT
The bill would amend Part 111 (Hazardous Waste Management) of the Natural Resources and Environmental Protection Act to require the Department of Environmental Quality, within one year after the bill's effective date, to promulgate a rule incorporating 40 CFR 264.1050(h) and 40 CFR 265.1050(g) by reference.
(Part 264 of the Code of Federal Regulations prescribes standards for owners and operators of hazardous waste treatment, storage, and disposal facilities. Part 265 prescribes interim standards for those facilities. The regulations cited in the bill provide that purged coatings and solvents from surface coating operations subject to the National Emission Standards for Hazardous Air Pollutants (NESHAP) for the surface coating of automobiles and light-duty trucks are not subject to regulations applicable to air emission standards for equipment leaks.)
The bill also specifies that, as exceptions to the requirements of rules promulgated under Part 111, the State would adopt those Federal regulations.
The bill would delete a provision that adopts by reference the standards for universal waste management with regard to batteries under 40 CFR 273.1 to 273.81.
The section the bill would amend would be repealed two years after the bill took effect.

FISCAL IMPACT
The bill would cost the State a small amount for staff responsibilities related to the rule promulgation process.
