SUBSTITUTE FOR

 

HOUSE BILL NO. 4133

 

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1961 PA 236, entitled

 

"Revised judicature act of 1961,"

 

by amending section 1831 (MCL 600.1831), as amended by 1984 PA 29.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1831. (1) Civil process shall not be served on  any  an

 

elector entitled to vote at  any  an election during the day that

 

election is held.  ; but upon  However, if sufficient cause is

 

shown by affidavit to the satisfaction of a judge,  of any circuit,

 

that judge may  make any  issue a restraining order or authorize

 

the issuance and service or execution of  any  a writ on  any  an

 

election day, as on other days.

 

     (2) Civil process shall not be served or executed on  Sunday;

 

but upon sufficient cause being shown by affidavit to the

 


satisfaction of a judge of any circuit, that judge may make any

 

restraining order or authorize the issuance of and service or

 

execution of any writ on Sunday, as on other days  a person while

 

he or she is attending a worship meeting of a religious

 

organization that has tax exempt status under section 501(c)(3) of

 

the internal revenue code, 26 USC 501, in a place where the

 

organization normally conducts its worship. A judge may order

 

service or execution of process notwithstanding this subsection if,

 

to the judge's satisfaction, sufficient cause is shown by

 

affidavit.
