HOUSE BILL No. 4962

 

June 16, 2005, Introduced by Reps. Drolet, Gosselin, Hoogendyk and Stahl and referred to the Committee on Government Operations.

 

     A bill to amend 1984 PA 431, entitled

 

"The management and budget act,"

 

by amending section 298c (MCL 18.1298c), as added by 1988 PA 306.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 298c. The Michigan capitol park commission shall do all

 

of the following:

 

     (a) Develop a master plan for, and manage the development and

 

operation of, the Michigan capitol park.

 

     (b) Promulgate rules pursuant to the administrative procedures

 

act of 1969,  Act No. 306 of the Public Acts of 1969, being

 

sections 24.201 to 24.328 of the Michigan Compiled Laws  1969 PA

 

306, MCL 24.201 to 24.328, necessary to carry out its powers and

 

duties under this section.

     (c) Be responsible for the operation of programs, exclusive of

 

physical building management and maintenance, within the

 

jurisdiction of the Michigan capitol park commission as determined

 

under section 298b.

 

     (d) Act as an advisory body to the department regarding the

 

development and operation of real property in Lansing not

 

designated as part of the Michigan capitol park under section 298b.

 

     (e) Confer and cooperate with the Michigan capitol committee

 

in the execution of its duties under chapter 7 of the legislative

 

council act,  Act No. 268 of the Public Acts of 1986, being

 

sections 4.1701 to 4.1702 of the Michigan Compiled Laws  1986 PA

 

268, MCL 4.1701 to 4.1702.

 

     (f) Coordinate with the city of Lansing any state activities

 

or developments in and around the Michigan capitol park.

 

     (g) Advise the department of state police regarding the

 

provision of police and security services for the Michigan capitol

 

park, and the enforcement of rules for the care and preservation of

 

the Michigan capitol park.

 

     (h) When sufficient funds are received to meet the costs of

 

placement, place the plaque honoring the right to bear arms under

 

amendment II of the constitution of the United States and under

 

section 6 of article I of the state constitution of 1963 that is

 

donated to the Michigan capitol park commission by Brassroots.

     [(I) when sufficient funds are received to meet the costs of placement, place a plaque honoring the first amendment of the constitution of the united states and article I of the state constitution of 1963 that is donated by the american civil liberties union, The Michigan Press ASSOCIATION, THE mICHIGAN aSSOCIATION of broadcasters, league of women voters, the Thomas Jefferson Center for the protection of Free eXPRESSION, THE aMERICAN lIBRARIES aSSOCIATION, THE AMERICAN BOOKSELLERS fOUNDATION FOR FREE EXPRESSION, REPORTERS COMMITTEE FOR FREEDOM OF THE PRESS, or other organization wiTH a similar history of supporting and advocating for first amendment rights. the plaque will be subject to review by the capitol park commission prior to placement and should be of reasonable size, quality, construction, and nonpartisan in

nature.  The capitol park commission's approval shall be not unreasonably withheld, delayed, or denied.

     (j) when sufficient funds are received to meet the costs of placement, place a plaque, approved by the capitol park commission honoring the 13th, the 14th,, the 15th, or any other or combination of other amendments to the constitution of the united states or article I of the state constitution of 1963, donated by any person or organization. ANY SUCH plaque will be subject to review by the capitol park commission prior to placement and should be of reasonable size, quality, construction, and nonpartisan in nature.  The capitol park commission's approval shall be not unreasonably withheld, delayed, or denied.

     (k)]  (h)  Annually report to the governor and the legislature

 

on the activities of the Michigan capitol park commission. The

 

report shall review the progress of, and any changes in, the master

 

plan as well as the development and operation of the Michigan

 


capitol park.
