HOUSE BILL NO. 5439

 

 

 

 

 

 

 

 

 

 

 

 

 

      A bill to amend 1939 PA 280, entitled

 

"The social welfare act,"

 

by amending section 57b (MCL 400.57b), as amended by 1999 PA 9.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

 1        Sec. 57b. (1) Subject to section 57l, an individual who meets

 

 2  all of the following requirements is eligible for family

 

 3  independence assistance:

 

 4        (a) Is a member of a family or a family independence

 

 5  assistance group.

 

 6        (b) Is a member of a program group whose income and assets

 

 7  are less than the income and asset limits set by the  family

 

 8  independence agency  department.

 


 1        (c) In the case of a minor parent, meets the requirements of

 

 2  subsection (2).

 

 3        (d) Is a United States citizen, a permanent resident alien,

 

 4  or a refugee.

 

 5        (e) Is a resident of this state as described in section 32.

 

 6        (f) Meets any other eligibility criterion required for the

 

 7  receipt of federal or state funds or determined by the  family

 

 8  independence agency  department to be necessary for the

 

 9  accomplishment of the goals of the family independence program.

 

10        (2) A minor parent and the minor parent's child shall not

 

11  receive family independence assistance unless they live in an

 

12  adult-supervised household. The family independence assistance

 

13  shall be paid on behalf of the minor parent and child to an adult

 

14  in the adult-supervised household. Child care in conjunction with

 

15  participation in education, employment readiness, training, or

 

16  employment programs,  which  that have been approved by the  

 

17  family independence agency  department, shall be provided for the

 

18  minor parent's child. The minor parent and child shall live with

 

19  the minor parent's parent, stepparent, or legal guardian unless

 

20  the family independence agency  department determines that there

 

21  is good cause for not requiring the minor parent and child to

 

22  live with a parent, stepparent, or legal guardian. The  family

 

23  independence agency  department shall determine the circumstances

 

24  that constitute good cause, based on a parent's, stepparent's, or

 

25  guardian's unavailability or unwillingness or based on a

 

26  reasonable belief that there is physical, sexual, or substance

 

27  abuse, or domestic violence, occurring in the household, or that

 


 1  there is other risk to the physical or emotional health or safety

 

 2  of the minor parent or child. If the  family independence agency  

 

 3  department determines that there is good cause for not requiring

 

 4  a minor parent to live with a parent, stepparent, or legal

 

 5  guardian, the minor parent and child shall live in another adult-

 

 6  supervised household. A local office director may waive the

 

 7  requirement set forth in this subsection with respect to a minor

 

 8  parent who is at least 17 years of age, attending secondary

 

 9  school full-time, and participating in a department service plan  

 

10  of the family independence agency  or a teen parenting program,

 

11  if moving would require the minor parent to change schools.

 

12        (3) In determining a program group's family independence

 

13  assistance monthly payment standard, the department shall not

 

14  take into consideration in its calculation of the payment

 

15  standard the geographical area or shelter area in which the

 

16  program group resides. The department shall not adjust a program

 

17  group's family independence assistance payment standard based on

 

18  whether a recipient is exempt from work first requirements under

 

19  section 57f.

 

20        (4) The family independence assistance monthly payment

 

21  standard for households in which only the eligible children are

 

22  counted in determining family size, or if the grantee is

 

23  receiving supplemental security income, shall be paid at an

 

24  amount not to exceed the amount per family size listed as

 

25  follows:

 8        (5) For all other individuals eligible to receive family

 

 9  independence assistance, the family independence assistance

 

10  monthly payment standard shall be paid at an amount not to exceed

 

11  the amount per family size listed as follows:

(6) For the purposes of determining the payment standard under subsections (4) and (5), for a family of 8 or more, the payment standard is increased by $79.00 for each additional family member over 7.>>

 

21        <<(7)>> The department may contract with a nonprofit

 

22  organization to assist recipients with the process for applying

 

23  for supplemental security income.

 

24        Enacting section 1.  This amendatory act does not take

 

25  effect unless all of the following bills of the 93rd Legislature

 

26  are enacted into law:

 

27        (a) Senate Bill No. 892.

 2        (c) Senate Bill No. 894.

 

 3        (d) House Bill No. 5438.
