A bill to amend 1991 PA 179, entitled
"Michigan telecommunications act,"
(MCL 484.2101 to 484.2701) by adding section 364.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 364. (1) A telecommunication provider of basic local
exchange service shall not refuse to transfer or delay the transfer
of a basic local exchange service customer to another provider of
basic local exchange service.
(2) Within 90 days after the effective date of the amendatory
act that added this section, the commission shall establish by
order uniform statewide standards and procedures for the timely
transfer of customers between providers of basic local exchange
service, including uniform maximum time periods within which a
customer's current provider shall effect a transfer of the customer
to the customer's chosen new provider.
(3) The procedures and time periods established under
subsection (2) shall be consistent with any applicable procedures
and time periods established by the federal communications
commission.
(4) Until the procedures and time periods are established
under subsection (2), a basic local exchange provider shall perform
all of the operations necessary for the timely transfer of
customers, in accordance with the performance standards and
measurements previously established by the commission for the
largest incumbent basic local exchange service provider in this
state.
