     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding section 21555.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 21555. (1) To examine means to improve patient safety and

 

reduce hospital-acquired infections in this state, the governor

 

shall create and appoint a commission on hospital-acquired

 

infections within the department of community health or designate

 

an existing organization to act as the state commission on

 

hospital-acquired infections.  If the governor chooses to designate

 

an existing organization to act as the state commission, the

 

organization shall include, but is not limited to, individuals with

 

education, experience, and expertise in health and human services,


 

infection control, and epidemiology.  If the governor chooses to

 

create a commission, the commission shall consist of 7 members, 3

 

of whom are appointed jointly by the speaker of the house of

 

representatives and the senate majority leader and 4 of whom are

 

appointed by the governor as follows:

 

     (a) One individual from the general public who has experience

 

in hospital operations and infection control.

 

     (b) Four individuals representing hospitals whose primary

 

profession is focusing on the control and elimination of hospital-

 

acquired infections.

 

     (c) Two epidemiologists who specialize in hospital-acquired

 

infections.

 

     (2) Within 1 year after the commission is appointed or

 

designated by the governor, the commission shall develop

 

recommendations and issue a written report of those recommendations

 

for the hospital industry on the best practices for minimizing and

 

eliminating hospital-acquired infections that are consistent with

 

the centers for disease control and prevention guidelines. 

 

     (3) The commission shall conduct public hearings and consider

 

all information received from those public hearings in making its

 

recommendations as required under subsection (2). 

 

     (4) The commission shall conduct a study of peer-reviewed

 

literature on the subject of hospital-acquired infections and the

 

best practices for reducing and eliminating hospital-acquired

 

infections.

 

     (5) The commission shall conduct its business as the

 

commission at a public meeting of the commission held in compliance


 

with the open meetings act, 1976 PA 267, MCL 15.261 to 15.275.  The

 

commission shall give public notice of the time, date, and place of

 

the meeting in the manner required by the open meetings act, 1976

 

PA 267, MCL 15.261 to 15.275.

 

     (6) The commission shall make available to the public a

 

writing prepared, owned, used, in the possession of, or retained by

 

the commission in the performance of an official function of the

 

commission in compliance with the freedom of information act, 1976

 

PA 442, MCL 15.231 to 15.246.

 

     (7) As used in this section, "commission" means the commission

 

created and appointed as provided under subsection (1) or the

 

organization designated to act as the commission by the governor as

 

provided under subsection (1).
