A bill to amend 1976 PA 388, entitled
"Michigan campaign finance act,"
(MCL 169.201 to 169.282) by adding section 48.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 48. (1) A person who pays for the publication of a
written communication or the broadcast of a radio or television
communication that relates to a candidate and that is published or
broadcast within 60 days before an election shall submit a report
to the secretary of state under subsection (2) within 48 hours of
the date of the first publication or broadcast of the
communication.
(2) A report required under subsection (1) shall be submitted
electronically over the internet in the manner prescribed by the
secretary of state. The report shall include all of the following
information:
(a) The name and address of the person who paid for the
communication.
(b) The cost of publishing or broadcasting the communication.
(c) The name of the candidate to whom the communication
relates.
(d) The full name and street address of each person from whom
the person who paid for the publication or broadcast received money
that was intended by the person giving the money to be used or that
was actually used to pay for the publication or broadcast, and the
amount of money received.
(3) This section does not apply to the publication or
broadcast of an editorial comment or a letter to the editor.
(4) A person who violates this section is liable for a civil
fine of not more than $10,000.00 or the amount paid for the
publication or broadcast, whichever is greater.
