SENATE BILL No. 680

     A bill to amend 1994 PA 451, entitled

 

"Natural resources and environmental protection act,"

 

(MCL 324.101 to 324.90106) by adding part 175.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

PART 175. "RECYCLING WORKS" FUND

 

     Sec. 17501. As used in this part:

 

     (a) "Department" means the department of environmental

 

quality.

 

     (b) "Fund" means the "recycling works" fund created in section

 

17503.

 

     Sec. 17503. (1) The "recycling works" fund is created within

 

the state treasury.

 

     (2) The state treasurer may receive for deposit into the fund

 

money appropriated for this purpose under section 437 of the income


 

tax act of 1967, 1967 PA 281, MCL 206.437, and money or other

 

assets from contributions from any source.  The state treasurer

 

shall direct the investment of the fund.  The state treasurer shall

 

credit to the fund interest and earnings from fund investments.

 

     (3) Money in the fund at the close of the fiscal year shall

 

remain in the fund and shall not lapse to the general fund.

 

     (4) The department shall expend money from the fund, upon

 

appropriation, only to fund statewide recycling programs.

 

     Enacting section 1.  This amendatory act does not take effect

 

unless Senate Bill No. 679                                    

 

          of the 93rd Legislature is enacted into law.
