A bill to amend 1937 PA 329, entitled
"An act providing for compensation to certain peace officers
injured in active duty, and payment to surviving spouses and
dependents in case of death arising from active duty; and to make
an appropriation therefor,"
by amending section 3 (MCL 419.103), as amended by 2002 PA 103.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
3. (1) The amount Except as provided in subsection (2),
the payments provided for in this act shall be paid from the state
general
fund. of the state treasury, from money appropriated from
said
general fund for the fiscal year ending June 30, 1938, and
every
fiscal year thereafter, a sufficient sum to carry out the
provisions
of this act.
(2) Money in the public safety officers benefit fund, created
under section 3 of the public officers benefit act, 2004 PA 46, MCL
28.633, may be expended for the purposes described in section 2.
Subject to subsection (3), the commission on law enforcement
standards, created under the commission on law enforcement
standards act, 1965 PA 203, MCL 28.601 to 28.616, shall direct the
payment of any funds described in this subsection.
(3) The department of attorney general shall review all claims
under
this act and satisfy himself or herself of verify the
merits of the claim before authorizing payment.
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No. 741
of the 93rd Legislature is enacted into law.
